77 relating to the operation of a student health center of an
88 institution of higher education.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Section 51.953, Education Code,
1111 is amended to read as follows:
1212 Sec. 51.953. [CERTAIN REVENUE RECEIVED FROM] STUDENT HEALTH
1313 CENTER [SERVICES].
1414 SECTION 2. Section 51.953, Education Code, is amended by
1515 adding Subsections (c), (d), and (e) to read as follows:
1616 (c) The student health center of an institution of higher
1717 education shall assist a student or other person entitled to obtain
1818 health care services from the health center in receiving benefits
1919 under a health benefit plan by filing or having a claim filed with
2020 the health benefit plan issuer on behalf of the student or other
2121 person.
2222 (d) An institution of higher education on behalf of the
2323 institution's student health center located within the geographic
2424 service area of a health benefit plan may contract with the health
2525 benefit plan issuer to provide health care services under the plan
2626 to students or other persons entitled to obtain health care
2727 services from the health center who are covered by the plan.
2828 (e) Not later than January 15 of each year, the governing
2929 board of an institution of higher education shall report to the
3030 legislature the amount of the following sources of income for
3131 funding the institution's student health center:
3232 (1) money received from student fees and charges;
3333 (2) money received from the operation of the student
3434 health center's pharmacy;
3535 (3) money received as a result of a claim filed by or
3636 on behalf of the institution's student health center under a health
3737 benefit plan sponsored by or administered on behalf of the
3838 institution; and
3939 (4) money received as a result of a claim filed by or
4040 on behalf of the institution's student health center under a health
4141 benefit plan other than a plan sponsored by or administered on
4242 behalf of the institution.
4343 SECTION 3. This Act takes effect September 1, 2009.
