| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. The heading to Section 51.953, Education Code, |
|---|
| 11 | 11 | | is amended to read as follows: |
|---|
| 12 | 12 | | Sec. 51.953. [CERTAIN REVENUE RECEIVED FROM] STUDENT HEALTH |
|---|
| 13 | 13 | | CENTER [SERVICES]. |
|---|
| 14 | 14 | | SECTION 2. Section 51.953, Education Code, is amended by |
|---|
| 15 | 15 | | adding Subsections (c), (d), and (e) to read as follows: |
|---|
| 16 | 16 | | (c) The student health center of an institution of higher |
|---|
| 17 | 17 | | education shall assist a student or other person entitled to obtain |
|---|
| 18 | 18 | | health care services from the health center in receiving benefits |
|---|
| 19 | 19 | | under a health benefit plan by filing or having a claim filed with |
|---|
| 20 | 20 | | the health benefit plan issuer on behalf of the student or other |
|---|
| 21 | 21 | | person. |
|---|
| 22 | 22 | | (d) An institution of higher education on behalf of the |
|---|
| 23 | 23 | | institution's student health center located within the geographic |
|---|
| 24 | 24 | | service area of a health benefit plan may contract with the health |
|---|
| 25 | 25 | | benefit plan issuer to provide health care services under the plan |
|---|
| 26 | 26 | | to students or other persons entitled to obtain health care |
|---|
| 27 | 27 | | services from the health center who are covered by the plan. |
|---|
| 28 | 28 | | (e) Not later than January 15 of each year, the governing |
|---|
| 29 | 29 | | board of an institution of higher education shall report to the |
|---|
| 30 | 30 | | legislature the amount of the following sources of income for |
|---|
| 31 | 31 | | funding the institution's student health center: |
|---|
| 32 | 32 | | (1) money received from student fees and charges; |
|---|
| 33 | 33 | | (2) money received from the operation of the student |
|---|
| 34 | 34 | | health center's pharmacy; |
|---|
| 35 | 35 | | (3) money received as a result of a claim filed by or |
|---|
| 36 | 36 | | on behalf of the institution's student health center under a health |
|---|
| 37 | 37 | | benefit plan sponsored by or administered on behalf of the |
|---|
| 38 | 38 | | institution; and |
|---|
| 39 | 39 | | (4) money received as a result of a claim filed by or |
|---|
| 40 | 40 | | on behalf of the institution's student health center under a health |
|---|
| 41 | 41 | | benefit plan other than a plan sponsored by or administered on |
|---|
| 42 | 42 | | behalf of the institution. |
|---|
| 43 | 43 | | SECTION 3. This Act takes effect September 1, 2009. |
