| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. The heading to Section 162.002, Family Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | Sec. 162.002. [PREREQUISITES TO] PETITION FOR ADOPTION. |
|---|
| 13 | 13 | | SECTION 2. Section 162.002, Family Code, is amended by |
|---|
| 14 | 14 | | adding Subsection (c) to read as follows: |
|---|
| 15 | 15 | | (c) If the parent-child relationship between a child and |
|---|
| 16 | 16 | | each living parent was previously terminated in a proceeding |
|---|
| 17 | 17 | | initiated by the Department of Family and Protective Services, a |
|---|
| 18 | 18 | | petition for adoption of the child shall be filed: |
|---|
| 19 | 19 | | (1) in the court that previously terminated the |
|---|
| 20 | 20 | | parent-child relationship between the child and each living parent; |
|---|
| 21 | 21 | | and |
|---|
| 22 | 22 | | (2) under the same cause number as the proceeding in |
|---|
| 23 | 23 | | which the parent-child relationships were terminated. |

| 24 | 24 | | SECTION 3. The changes in law made by this Act to Section |
|---|
| 25 | 25 | | 162.002, Family Code, apply to a petition for adoption that is filed |
|---|
| 26 | 26 | | on or after the effective date of this Act. A petition for adoption |
|---|
| 27 | 27 | | filed before the effective date of this Act is governed by the law |
|---|
| 28 | 28 | | in effect on the date the petition was filed, and the former law is |
|---|
| 29 | 29 | | continued in effect for that purpose. |
|---|
| 30 | 30 | | SECTION 4. This Act takes effect September 1, 2009. |
