66 AN ACT
77 relating to suits for adoption of a child in certain cases involving
88 the Department of Family and Protective Services.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Section 162.002, Family Code, is
1111 amended to read as follows:
1212 Sec. 162.002. [PREREQUISITES TO] PETITION FOR ADOPTION.
1313 SECTION 2. Section 162.002, Family Code, is amended by
1414 adding Subsection (c) to read as follows:
1515 (c) If the parent-child relationship between a child and
1616 each living parent was previously terminated in a proceeding
1717 initiated by the Department of Family and Protective Services, a
1818 petition for adoption of the child shall be filed:
1919 (1) in the court that previously terminated the
2020 parent-child relationship between the child and each living parent;
2121 and
2222 (2) under the same cause number as the proceeding in
2323 which the parent-child relationships were terminated.
2424 SECTION 3. The changes in law made by this Act to Section
2525 162.002, Family Code, apply to a petition for adoption that is filed
2626 on or after the effective date of this Act. A petition for adoption
2727 filed before the effective date of this Act is governed by the law
2828 in effect on the date the petition was filed, and the former law is
2929 continued in effect for that purpose.
3030 SECTION 4. This Act takes effect September 1, 2009.
