 A BILL TO BE ENTITLED
 AN ACT
 relating to suits for adoption of a child in certain cases involving
 the Department of Family and Protective Services.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. The heading to Section 162.002, Family Code, is
 amended to read as follows:
 Sec. 162.002. [PREREQUISITES TO] PETITION FOR ADOPTION.
 SECTION 2. Section 162.002, Family Code, is amended by
 adding Subsection (c) to read as follows:
 (c)  If the parent-child relationship between a child and
 each living parent was previously terminated in a proceeding
 initiated by the Department of Family and Protective Services, a
 petition for adoption of the child shall be filed:
 (1)  in the court that previously terminated the
 parent-child relationship between the child and each living parent;
 and
 (2)  under the same cause number as the proceeding in
 which the parent-child relationships were terminated.
 SECTION 3. The changes in law made by this Act to Section
 162.002, Family Code, apply to a petition for adoption that is filed
 on or after the effective date of this Act. A petition for adoption
 filed before the effective date of this Act is governed by the law
 in effect on the date the petition was filed, and the former law is
 continued in effect for that purpose.
 SECTION 4. This Act takes effect September 1, 2009.
