77 relating to the permissible uses of the state highway fund.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 201.115(d), Transportation Code, is
1010 amended to read as follows:
1111 (d) Notwithstanding Section 222.001, money in the state
1212 highway fund may be used to repay a loan under this section, if
1313 permissible under the Texas Constitution and appropriated by the
1414 legislature for that purpose.
1515 SECTION 2. Section 222.001, Transportation Code, is amended
1616 to read as follows:
1717 Sec. 222.001. USE OF STATE HIGHWAY FUND. (a) Money that is
1818 required to be used for public roadways by the Texas Constitution or
1919 federal law and that is deposited in the state treasury to the
2020 credit of the state highway fund, including money deposited to the
2121 credit of the state highway fund under Title 23, United States Code,
2222 may be used only:
2323 (1) to improve the state highway system; or
2424 (2) to mitigate adverse environmental effects that
2525 result directly from construction or maintenance of a state highway
2626 by the department[; or
2727 [(3) by the Department of Public Safety to police the
2828 state highway system and to administer state laws relating to
2929 traffic and safety on public roads].
3030 (b) Except as otherwise provided by this code, money in the
3131 state highway fund that is not described by Subsection (a) may be
3232 used only to improve the state highway system.
3333 SECTION 3. Section 222.073, Transportation Code, is amended
3434 to read as follows:
3535 Sec. 222.073. PURPOSES OF INFRASTRUCTURE BANK. To the
3636 extent permissible under [Notwithstanding] Section 222.001, the
3737 commission shall use money deposited in the bank to:
3838 (1) encourage public and private investment in
3939 transportation facilities both within and outside of the state
4040 highway system, including facilities that contribute to the
4141 multimodal and intermodal transportation capabilities of the
4242 state; and
4343 (2) develop financing techniques designed to:
4444 (A) expand the availability of funding for
4545 transportation projects and to reduce direct state costs;
4646 (B) maximize private and local participation in
4747 financing projects; and
4848 (C) improve the efficiency of the state
4949 transportation system.
5050 SECTION 4. Section 222.002, Transportation Code, is
5151 repealed.
5252 SECTION 5. This Act takes effect September 1, 2011.
5353 SECTION 6. This Act takes effect only if the constitutional
5454 amendment proposed by the 81st Legislature, Regular Session, 2009,
5555 to limit the purposes for which revenues from motor vehicle
5656 registration fees, taxes on motor fuels and lubricants, and certain
5757 revenues received from the federal government may be used is
5858 approved by the voters. If that amendment is not approved by the
5959 voters, this Act has no effect.
