8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. TITLE 3. Subtitle C, Chapter 323, Government | |
10 | 10 | Code, is amended by adding Section 323.002 to read as follows: | |
11 | 11 | Sec. 323.002. EXECUTIVE DIRECTOR. (a) The council shall | |
12 | 12 | appoint an executive director to serve at the pleasure of the | |
13 | 13 | council. The director is accountable only to the council. | |
14 | 14 | (b) The director must be a licensed attorney in the State of | |
15 | 15 | Texas and must maintain an active license to practice law according | |
16 | 16 | to the regulations set out by the State Bar of Texas throughout the | |
17 | 17 | tenure of the appointment. | |
18 | 18 | (c) The director may make recommendations and, when the | |
19 | 19 | council specifically requests, shall make recommendations on a | |
20 | 20 | matter before the council relating to a function or duty of any | |
21 | 21 | state institution, department, agency, officer, or employee. | |
22 | 22 | (d) The director may not vote on a question or issue before | |
23 | 23 | the council. | |
24 | 24 | (e) The council shall set the salary of the director. | |
25 | 25 | SECTION 2. This Act takes effect September 1, 2009. |
