55 AN ACT
66 relating to the appointment of an Executive Director in the Texas
77 Legislative Council.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. TITLE 3. Subtitle C, Chapter 323, Government
1010 Code, is amended by adding Section 323.002 to read as follows:
1111 Sec. 323.002. EXECUTIVE DIRECTOR. (a) The council shall
1212 appoint an executive director to serve at the pleasure of the
1313 council. The director is accountable only to the council.
1414 (b) The director must be a licensed attorney in the State of
1515 Texas and must maintain an active license to practice law according
1616 to the regulations set out by the State Bar of Texas throughout the
1717 tenure of the appointment.
1818 (c) The director may make recommendations and, when the
1919 council specifically requests, shall make recommendations on a
2020 matter before the council relating to a function or duty of any
2121 state institution, department, agency, officer, or employee.
2222 (d) The director may not vote on a question or issue before
2323 the council.
2424 (e) The council shall set the salary of the director.
2525 SECTION 2. This Act takes effect September 1, 2009.
