 A BILL TO BE ENTITLED
 AN ACT
 relating to the appointment of an Executive Director in the Texas
 Legislative Council.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. TITLE 3. Subtitle C, Chapter 323, Government
 Code, is amended by adding Section 323.002 to read as follows:
 Sec. 323.002.  EXECUTIVE DIRECTOR.  (a)  The council shall
 appoint an executive director to serve at the pleasure of the
 council.  The director is accountable only to the council.
 (b)  The director must be a licensed attorney in the State of
 Texas and must maintain an active license to practice law according
 to the regulations set out by the State Bar of Texas throughout the
 tenure of the appointment.
 (c)  The director may make recommendations and, when the
 council specifically requests, shall make recommendations on a
 matter before the council relating to a function or duty of any
 state institution, department, agency, officer, or employee.
 (d)  The director may not vote on a question or issue before
 the council.
 (e) The council shall set the salary of the director.
 SECTION 2. This Act takes effect September 1, 2009.
