77 relating to the powers and duties of the Denton County Municipal
88 Utility District No. 4 and the Denton County Municipal Utility
99 District No. 5; providing authority to impose a tax and issue bonds;
1010 granting a limited power of eminent domain.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1313 Code, is amended by adding Chapters 8308 and 8309 to read as
1414 follows:
1515 CHAPTER 8308. DENTON COUNTY MUNICIPAL
1616 UTILITY DISTRICT NO. 4
1717 SUBCHAPTER A. GENERAL PROVISIONS
1818 Sec. 8308.001. DEFINITION. In this chapter, "district"
1919 means the Denton County Municipal Utility District No. 4.

2121 SUBCHAPTER B. POWERS AND DUTIES
2222 Sec. 8308.051. MUNICIPAL UTILITY DISTRICT POWERS AND
2323 DUTIES. The district has the powers and duties provided by the
2424 general law of this state, including Chapters 49 and 54, Water Code,
2525 applicable to municipal utility districts created under Section 59,
2626 Article XVI, Texas Constitution.
2727 Sec. 8308.052. AUTHORITY FOR ROAD PROJECTS. Under Section
2828 52, Article III, Texas Constitution, the district may design,
2929 acquire, construct, finance, issue bonds for, improve, operate,
3030 maintain and convey to this state, a county, or a municipality for
3131 operation and maintenance macadamized, graveled, or paved roads, or
3232 improvements, including storm drainage, in aid of those roads.
3333 Sec. 8308.053. ROAD STANDARDS AND REQUIREMENTS. (a) A road
3434 project must meet all applicable construction standards, zoning and
3535 subdivision requirements, and regulations of each municipality in
3636 whose corporate limits or extraterritorial jurisdiction the road
3737 project is located.
3838 (b) If a road project is not located in the corporate limits
3939 or extraterritorial jurisdiction of a municipality, the road
4040 project must meet all applicable construction standards,
4141 subdivision requirements, and regulations of each county in which
4242 the road project is located.
4343 (c) If the state will maintain and operate the road, the
4444 Texas Transportation Commission must approve the plans and
4545 specifications of the road project.
4646 Sec. 8308.054. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
4747 OR RESOLUTION. The district shall comply with all applicable
4848 requirements of an ordinance or resolution that is adopted under
4949 Section 54.016 or 54.0165, Water Code, and that consents to the
5050 creation of the district or to the inclusion of land in the
5151 district.
5252 Sec. 8308.055. LIMITATION ON USE OF EMINENT DOMAIN. The
5353 district may not exercise the power of eminent domain outside the
5454 district to acquire a site or easement for:
5555 (1) a road project authorized by Section 8308.052; or
5656 (2) a recreational facility as defined by Section
5757 49.462, Water Code.

6060 Sec. 8308.101. TAX TO REPAY BONDS. The district may impose
6161 a tax to pay the principal of or interest on bonds issued under
6262 Section 8308.151.

6464 SUBCHAPTER D. BONDS AND OTHER OBLIGATIONS
6565 Sec. 8308.151. AUTHORITY TO ISSUE BONDS AND OTHER
6666 OBLIGATIONS. The district may issue bonds or other obligations
6767 payable wholly or partly from ad valorem taxes, impact fees,
6868 revenue, contract payments, grants, or other district money, or any
6969 combination of those sources, to pay for any authorized district
7070 purpose.
7171 Sec. 8308.152. TAXES FOR BONDS. At the time the district
7272 issues bonds payable wholly or partly from ad valorem taxes, the
7373 district shall provide for the annual imposition of a continuing
7474 direct ad valorem tax, without limit as to rate or amount, while all
7575 or part of the bonds are outstanding as required and in the manner
7676 provided by Sections 54.601 and 54.602, Water Code.
7777 Sec. 8308.153. BONDS FOR ROAD PROJECTS. (a) The district
7878 may not issue bonds payable from ad valorem taxes to finance a road
7979 project unless the issuance is approved by a vote of a two-thirds
8080 majority of the district voters voting at an election held for that
8181 purpose.
8282 (b) At the time of issuance, the total principal amount of
8383 bonds or other obligations issued or incurred to finance road
8484 projects and payable from ad valorem taxes may not exceed
8585 one-fourth of the assessed value of the real property in the
8686 district.

159159 SECTION 2. (a) The legal notice of the intention to
160160 introduce this Act, setting forth the general substance of this
161161 Act, has been published as provided by law, and the notice and a
162162 copy of this Act have been furnished to all persons, agencies,
163163 officials, or entities to which they are required to be furnished
164164 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
165165 Government Code.
166166 (b) The governor, one of the required recipients, has
167167 submitted the notice and Act to the Texas Commission on
168168 Environmental Quality.
169169 (c) The Texas Commission on Environmental Quality has filed
170170 its recommendations relating to this Act with the governor, the
171171 lieutenant governor, and the speaker of the house of
172172 representatives within the required time.
173173 (d) All requirements of the constitution and laws of this
174174 state and the rules and procedures of the legislature with respect
175175 to the notice, introduction, and passage of this Act are fulfilled
176176 and accomplished.
177177 SECTION 3. This Act takes effect immediately if it receives
178178 a vote of two-thirds of all the members elected to each house, as
179179 provided by Section 39, Article III, Texas Constitution. If this
180180 Act does not receive the vote necessary for immediate effect, this
181181 Act takes effect September 1, 2009.
