44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the requirements for the recommended and advanced
77 public high school programs.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Sections 28.025(b-1) and (b-2), Education Code,
1010 are amended to read as follows:
1111 (b-1) The State Board of Education by rule shall require
1212 that:
1313 (1) except as provided by Subsection (b-2), the
1414 curriculum requirements for the recommended and advanced high
1515 school programs under Subsection (a) include a requirement that
1616 students successfully complete:
1717 (A) four courses in each subject of the
1818 foundation curriculum under Section 28.002(a)(1); or
1919 (B) a career and technology curriculum that:
2020 (i) provides a program of rigorous,
2121 standards-based coursework designed to prepare students for
2222 obtaining a license, certificate, or credential required for
2323 employment in a field of business or industry; and
2424 (ii) prescribes successful completion of
2525 three courses in mathematics, three courses in science, and four
2626 courses in each other subject of the foundation curriculum under
2727 Section 28.002(a)(1); and
2828 (2) one or more courses offered in the required
2929 curriculum for the recommended and advanced high school programs
3030 include a research writing component.
3131 (b-2) In adopting rules under Subsection (b-1), the State
3232 Board of Education shall allow a student to comply with the
3333 curriculum requirements for a mathematics course under Subsection
3434 (b-1)(1)(A) [(b-1)(1)] taken after the successful completion of an
3535 Algebra II course or science course under Subsection (b-1)(1)(A)
3636 [(b-1)(1)] taken after the successful completion of a physics
3737 course by successfully completing an advanced career and technology
3838 [technical] course designated by the State Board of Education as
3939 containing substantively similar and rigorous academic content. A
4040 student may use the option provided by this subsection for not more
4141 than two courses.
4242 SECTION 2. Not later than January 1, 2010, the State Board
4343 of Education shall adopt rules as required by Section 28.025(b-1),
4444 Education Code, as amended by this Act. The rules shall provide
4545 that the curriculum requirements for the recommended and advanced
4646 high school programs adopted under that subsection apply to a
4747 student regardless of the school year in which the student entered
4848 the ninth grade.
4949 SECTION 3. This Act takes effect immediately if it receives
5050 a vote of two-thirds of all the members elected to each house, as
5151 provided by Section 39, Article III, Texas Constitution. If this
5252 Act does not receive the vote necessary for immediate effect, this
5353 Act takes effect September 1, 2009.
