55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to providing certain parents with written and audiotaped
88 translations of individualized education programs developed for
99 public school students receiving special education services.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 29.005(d), Education Code, is amended to
1212 read as follows:
1313 (d) If the child's parent is unable to speak English, the
1414 district shall:
1515 (1) provide the parent with [a] written and [or]
1616 audiotaped copies [copy] of the child's individualized education
1717 program translated into Spanish if Spanish is the parent's native
1818 language; or
1919 (2) if the parent's native language is a language other
2020 than Spanish, make a good faith effort to provide the parent with
2121 [a] written and [or] audiotaped copies [copy] of the child's
2222 individualized education program translated into the parent's
2323 native language.
2424 SECTION 2. This Act applies beginning with the 2009-2010
2525 school year.
2626 SECTION 3. This Act takes effect immediately if it receives
2727 a vote of two-thirds of all the members elected to each house, as
2828 provided by Section 39, Article III, Texas Constitution. If this
2929 Act does not receive the vote necessary for immediate effect, this
3030 Act takes effect September 1, 2009.
