9 | 9 | public school students receiving special education services. | |
10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Section 29.005(d), Education Code, is amended to | |
12 | 12 | read as follows: | |
13 | 13 | (d) If the child's parent is unable to speak English, the | |
14 | 14 | district shall: | |
15 | 15 | (1) provide the parent with [a] written and [or] | |
16 | 16 | audiotaped copies [copy] of the child's individualized education | |
17 | 17 | program translated into Spanish if Spanish is the parent's native | |
18 | 18 | language; or | |
19 | 19 | (2) if the parent's native language is a language other | |
20 | 20 | than Spanish, make a good faith effort to provide the parent with | |
21 | 21 | [a] written and [or] audiotaped copies [copy] of the child's | |
22 | 22 | individualized education program translated into the parent's | |
23 | 23 | native language. | |
24 | 24 | SECTION 2. This Act applies beginning with the 2009-2010 | |
25 | 25 | school year. | |
26 | 26 | SECTION 3. This Act takes effect immediately if it receives | |
27 | 27 | a vote of two-thirds of all the members elected to each house, as | |
28 | 28 | provided by Section 39, Article III, Texas Constitution. If this | |
29 | 29 | Act does not receive the vote necessary for immediate effect, this | |
30 | 30 | Act takes effect September 1, 2009. |
