 A BILL TO BE ENTITLED
 AN ACT
 relating to providing certain parents with written and audiotaped
 translations of individualized education programs developed for
 public school students receiving special education services.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Section 29.005(d), Education Code, is amended to
 read as follows:
 (d) If the child's parent is unable to speak English, the
 district shall:
 (1) provide the parent with [a] written and [or]
 audiotaped copies [copy] of the child's individualized education
 program translated into Spanish if Spanish is the parent's native
 language; or
 (2) if the parent's native language is a language other
 than Spanish, make a good faith effort to provide the parent with
 [a] written and [or] audiotaped copies [copy] of the child's
 individualized education program translated into the parent's
 native language.
 SECTION 2. This Act applies beginning with the 2009-2010
 school year.
 SECTION 3. This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution. If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2009.
