| 6 | 6 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 7 | 7 | | SECTION 1. Section 352.002, Tax Code, is amended by adding |
|---|
| 8 | 8 | | Subsection (i) to read as follows: |
|---|
| 9 | 9 | | (i) The commissioners court of a county in which the |
|---|
| 10 | 10 | | Declaration of Independence of the Republic of Texas was signed in |
|---|
| 11 | 11 | | 1836 may impose a tax as provided by Subsection (a). A tax imposed |
|---|
| 12 | 12 | | under this subsection does not apply to a hotel located in a |
|---|
| 13 | 13 | | municipality that imposes a tax under Chapter 351 applicable to the |
|---|
| 14 | 14 | | hotel. |
|---|
| 15 | 15 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 16 | 16 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 17 | 17 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 18 | 18 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 19 | 19 | | Act takes effect September 1, 2009. |
