| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 481.078, Government Code, is amended by |
|---|
| 11 | 11 | | adding Subsection (k) to read as follows: |
|---|
| 12 | 12 | | (k) The fund may be used to make one or more grants to the |
|---|
| 13 | 13 | | Texas Department of Transportation to implement that department's |
|---|
| 14 | 14 | | powers and duties relating to rail facilities under Chapter 91, |
|---|
| 15 | 15 | | Transportation Code. Subsections (e-1), (f), (g), (h), (i), and (j) |
|---|
| 16 | 16 | | do not apply to a grant under this subsection. |
|---|
| 17 | 17 | | SECTION 2. Section 91.071(b), Transportation Code, is |
|---|
| 18 | 18 | | amended to read as follows: |
|---|
| 19 | 19 | | (b) Except for money received from the Texas economic |
|---|
| 20 | 20 | | development bank fund under Section 489.102, Government Code, or |
|---|
| 21 | 21 | | received as a grant from the Texas Enterprise Fund under Section |
|---|
| 22 | 22 | | 481.078, Government Code, the department may not spend money from |
|---|
| 23 | 23 | | the general revenue fund to implement this chapter except pursuant |
|---|
| 24 | 24 | | to a line-item appropriation. |
|---|
| 25 | 25 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 29 | | Act takes effect September 1, 2009. |
