A BILL TO BE ENTITLED
AN ACT
relating to use of money from the Texas Enterprise Fund for rail
projects.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 481.078, Government Code, is amended by
adding Subsection (k) to read as follows:
(k) The fund may be used to make one or more grants to the
Texas Department of Transportation to implement that department's
powers and duties relating to rail facilities under Chapter 91,
Transportation Code. Subsections (e-1), (f), (g), (h), (i), and (j)
do not apply to a grant under this subsection.
SECTION 2. Section 91.071(b), Transportation Code, is
amended to read as follows:
(b) Except for money received from the Texas economic
development bank fund under Section 489.102, Government Code, or
received as a grant from the Texas Enterprise Fund under Section
481.078, Government Code, the department may not spend money from
the general revenue fund to implement this chapter except pursuant
to a line-item appropriation.
SECTION 3. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2009.
