| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Subchapter I, Chapter 21, Education Code, is |
|---|
| 9 | 9 | | amended by adding Section 21.4031 to read as follows: |
|---|
| 10 | 10 | | Sec. 21.4031. PROFESSIONAL STAFF SERVICE RECORDS. (a) In |
|---|
| 11 | 11 | | this section: |
|---|
| 12 | 12 | | (1) "Salary schedule" means the minimum salary |
|---|
| 13 | 13 | | schedule under Section 21.402 or a comparable salary schedule used |
|---|
| 14 | 14 | | by a school district that specifies salary amounts based on an |
|---|
| 15 | 15 | | employee's level of experience. |
|---|
| 16 | 16 | | (2) "Service record" means a school district document |
|---|
| 17 | 17 | | that indicates the total years of service provided to the district |
|---|
| 18 | 18 | | by a classroom teacher, librarian, counselor, or nurse. |
|---|
| 19 | 19 | | (b) On request by a classroom teacher, librarian, |
|---|
| 20 | 20 | | counselor, or nurse or by the school district employing one of those |
|---|
| 21 | 21 | | individuals, a school district that previously employed the |
|---|
| 22 | 22 | | individual shall provide a copy of the individual's service record |
|---|
| 23 | 23 | | to the school district employing the individual. The district must |
|---|
| 24 | 24 | | provide the copy not later than the 30th day after the later of: |
|---|
| 25 | 25 | | (1) the date the request is made; or |
|---|
| 26 | 26 | | (2) the date of the last day of the individual's |
|---|
| 27 | 27 | | service to the district. |
|---|
| 28 | 28 | | (c) If a school district fails to provide an individual's |
|---|
| 29 | 29 | | service record as required by Subsection (b), the agency shall, to |
|---|
| 30 | 30 | | the extent that information is available to the agency, provide the |
|---|
| 31 | 31 | | employing school district with information sufficient to enable the |
|---|
| 32 | 32 | | district to determine proper placement of the individual on the |
|---|
| 33 | 33 | | district's salary schedule. |
|---|
| 34 | 34 | | SECTION 2. This Act applies beginning with the 2009-2010 |
|---|
| 35 | 35 | | school year. |
|---|
| 36 | 36 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 37 | 37 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 38 | 38 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 39 | 39 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 40 | 40 | | Act takes effect September 1, 2009. |
