1010 relating to the regulation of the transportation of oil and gas
1111 drill cuttings; providing a criminal penalty.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter B, Chapter 725, Transportation Code,
1414 is amended by adding Section 725.023 to read as follows:
1515 Sec. 725.023. REQUIREMENTS FOR TRANSPORTING OIL AND GAS
1616 DRILL CUTTINGS FROM CLOSED LOOP DRILLING WASTE OPERATIONS; OFFENSE.
1717 (a) A person commits an offense if the person or the person's agent
1818 or employee operates a motor vehicle that is used to transport a
1919 load of oil and gas drill cuttings generated from a closed loop
2020 drilling waste operation and the vehicle is not equipped and
2121 maintained in a manner that prevents the drill cuttings from
2222 escaping from the vehicle or being deposited on a public road or
2323 highway by the vehicle.
2424 (b) An offense under this section is a Class B misdemeanor.
2525 SECTION 2. This Act takes effect September 1, 2009.
