12 | 12 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
13 | 13 | SECTION 1. Subchapter B, Chapter 725, Transportation Code, | |
14 | 14 | is amended by adding Section 725.023 to read as follows: | |
15 | 15 | Sec. 725.023. REQUIREMENTS FOR TRANSPORTING OIL AND GAS | |
16 | 16 | DRILL CUTTINGS FROM CLOSED LOOP DRILLING WASTE OPERATIONS; OFFENSE. | |
17 | 17 | (a) A person commits an offense if the person or the person's agent | |
18 | 18 | or employee operates a motor vehicle that is used to transport a | |
19 | 19 | load of oil and gas drill cuttings generated from a closed loop | |
20 | 20 | drilling waste operation and the vehicle is not equipped and | |
21 | 21 | maintained in a manner that prevents the drill cuttings from | |
22 | 22 | escaping from the vehicle or being deposited on a public road or | |
23 | 23 | highway by the vehicle. | |
24 | 24 | (b) An offense under this section is a Class B misdemeanor. | |
25 | 25 | SECTION 2. This Act takes effect September 1, 2009. | |
