| 5 | 5 | | relating to the use of certain professional titles by interior |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 1053.002(a), Occupations Code, is |
|---|
| 9 | 9 | | amended to read as follows: |
|---|
| 10 | 10 | | (a) This chapter does not apply to: |
|---|
| 11 | 11 | | (1) a person who: |
|---|
| 12 | 12 | | (A) does not use the title "interior designer" |
|---|
| 13 | 13 | | and does not use the term "interior design" to describe a service |
|---|
| 14 | 14 | | the person offers or performs; and |
|---|
| 15 | 15 | | (B) is an interior designer licensed or |
|---|
| 16 | 16 | | registered in another state or country who: |
|---|
| 17 | 17 | | (i) does not open or maintain a business in |
|---|
| 18 | 18 | | this state; and |
|---|
| 19 | 19 | | (ii) complies with the requirements of |
|---|
| 20 | 20 | | Subsection (b); [or] |
|---|
| 21 | 21 | | (2) a person who is registered to practice |
|---|
| 22 | 22 | | architecture in this state; or |
|---|
| 23 | 23 | | (3) a person who does not use a business or |
|---|
| 24 | 24 | | professional title that uses the phrase "registered interior |
|---|
| 25 | 25 | | designer." |
|---|
| 26 | 26 | | SECTION 2. Section 1053.151, Occupations Code, is amended |
|---|
| 27 | 27 | | to read as follows: |
|---|
| 28 | 28 | | Sec. 1053.151. REGISTRATION REQUIRED. A person other than |
|---|
| 29 | 29 | | an interior designer may not[: |
|---|
| 30 | 30 | | [(1)] represent that the person is a "registered [an |
|---|
| 31 | 31 | | "] interior designer" by using that title or by using words that |
|---|
| 32 | 32 | | imply that the person is a registered interior designer [; or |
|---|
| 33 | 33 | | [(2) represent, by using the term "interior design," a |
|---|
| 34 | 34 | | service the person offers or performs]. |
|---|
| 35 | 35 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 36 | 36 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 37 | 37 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 38 | 38 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 39 | 39 | | Act takes effect September 1, 2009. |
