55 relating to the use of certain professional titles by interior

77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 1053.002(a), Occupations Code, is
99 amended to read as follows:
1010 (a) This chapter does not apply to:
1111 (1) a person who:
1212 (A) does not use the title "interior designer"
1313 and does not use the term "interior design" to describe a service
1414 the person offers or performs; and
1515 (B) is an interior designer licensed or
1616 registered in another state or country who:
1717 (i) does not open or maintain a business in
1818 this state; and
1919 (ii) complies with the requirements of
2020 Subsection (b); [or]
2121 (2) a person who is registered to practice
2222 architecture in this state; or
2323 (3) a person who does not use a business or
2424 professional title that uses the phrase "registered interior
2525 designer."
2626 SECTION 2. Section 1053.151, Occupations Code, is amended
2727 to read as follows:
2828 Sec. 1053.151. REGISTRATION REQUIRED. A person other than
2929 an interior designer may not[:
3030 [(1)] represent that the person is a "registered [an
3131 "] interior designer" by using that title or by using words that
3232 imply that the person is a registered interior designer [; or
3333 [(2) represent, by using the term "interior design," a
3434 service the person offers or performs].
3535 SECTION 3. This Act takes effect immediately if it receives
3636 a vote of two-thirds of all the members elected to each house, as
3737 provided by Section 39, Article III, Texas Constitution. If this
3838 Act does not receive the vote necessary for immediate effect, this
3939 Act takes effect September 1, 2009.
