 A BILL TO BE ENTITLED
 AN ACT
 relating to tuition exemptions at public institutions of higher
 education for dependents of certain military personnel deployed in
 combat zones.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Section 54.058, Education Code, is amended by
 adding Subsection (k) to read as follows:
 (k)  An institution of higher education shall exempt from the
 payment of tuition a dependent child, including a stepchild, of a
 member of the Armed Forces of the United States for a semester or
 other academic term during which the member of the armed forces is
 deployed to combat or a combat support posting in a foreign country.
 SECTION 2. Section 54.058(k), Education Code, as added by
 this Act, applies beginning with tuition charged by a public
 institution of higher education for the 2009-2010 academic year.
 SECTION 3. This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution. If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2009.
