77 relating to including information on Sudden Infant Death Syndrome
88 in a resource pamphlet for parents of newborn children.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 161.501(a), Health and Safety Code, is
1111 amended to read as follows:
1212 (a) A hospital, birthing center, physician, nurse midwife,
1313 or midwife who provides prenatal care to a pregnant woman during
1414 gestation or at delivery of an infant shall:
1515 (1) provide the woman and the father of the infant, if
1616 possible, or another adult caregiver for the infant, with a
1717 resource pamphlet that includes:
1818 (A) a list of the names, addresses, and phone
1919 numbers of professional organizations that provide postpartum
2020 counseling and assistance to parents relating to postpartum
2121 depression and other emotional trauma associated with pregnancy and
2222 parenting;
2323 (B) information regarding the prevention of
2424 shaken baby syndrome including:
2525 (i) techniques for coping with anger caused
2626 by a crying baby;
2727 (ii) different methods for preventing a
2828 person from shaking a newborn, infant, or other young child;
2929 (iii) the dangerous effects of shaking a
3030 newborn, infant, or other young child; and
3131 (iv) the symptoms of shaken baby syndrome
3232 and who to contact, as recommended by the American Academy of
3333 Pediatrics, if a parent suspects or knows that a baby has been
3434 shaken in order to receive prompt medical treatment;
3535 (C) a list of diseases for which a child is
3636 required by state law to be immunized and the appropriate schedule
3737 for the administration of those immunizations; [and]
3838 (D) the appropriate schedule for follow-up
3939 procedures for newborn screening; and
4040 (E) information regarding Sudden Infant Death
4141 Syndrome, including current recommendations for infant sleeping
4242 conditions to lower the risk of Sudden Infant Death Syndrome;
4343 (2) document in the woman's record that the woman
4444 received the information described in Subdivision (1); and
4545 (3) retain the documentation for at least five years
4646 in the hospital's, birthing center's, physician's, nurse midwife's,
4747 or midwife's records.
4848 SECTION 2. Not later than January 1, 2010, the Department of
4949 State Health Services shall update the resource pamphlet on the
5050 department's website to include the information about Sudden Infant
5151 Death Syndrome required by Section 161.501, Health and Safety Code,
5252 as amended by this Act.
5353 SECTION 3. A hospital, birthing center, physician, nurse
5454 midwife, or midwife who provides prenatal care to a pregnant woman
5555 during gestation or at delivery of an infant is not required to
5656 provide the updated brochure containing the information about
5757 Sudden Infant Death Syndrome required by Section 161.501, Health
5858 and Safety Code, as amended by this Act, before March 1, 2010.
5959 SECTION 4. This Act takes effect September 1, 2009.
