7 | 7 | | relating to including information on Sudden Infant Death Syndrome |

8 | 8 | | in a resource pamphlet for parents of newborn children. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
10 | 10 | | SECTION 1. Section 161.501(a), Health and Safety Code, is |
---|
11 | 11 | | amended to read as follows: |
---|
12 | 12 | | (a) A hospital, birthing center, physician, nurse midwife, |
---|
13 | 13 | | or midwife who provides prenatal care to a pregnant woman during |
---|
14 | 14 | | gestation or at delivery of an infant shall: |
---|
15 | 15 | | (1) provide the woman and the father of the infant, if |
---|
16 | 16 | | possible, or another adult caregiver for the infant, with a |
---|
17 | 17 | | resource pamphlet that includes: |
---|
18 | 18 | | (A) a list of the names, addresses, and phone |
---|
19 | 19 | | numbers of professional organizations that provide postpartum |
---|
20 | 20 | | counseling and assistance to parents relating to postpartum |
---|
21 | 21 | | depression and other emotional trauma associated with pregnancy and |
---|
22 | 22 | | parenting; |
---|
23 | 23 | | (B) information regarding the prevention of |
---|
24 | 24 | | shaken baby syndrome including: |
---|
25 | 25 | | (i) techniques for coping with anger caused |
---|
26 | 26 | | by a crying baby; |
---|
27 | 27 | | (ii) different methods for preventing a |
---|
28 | 28 | | person from shaking a newborn, infant, or other young child; |
---|
29 | 29 | | (iii) the dangerous effects of shaking a |
---|
30 | 30 | | newborn, infant, or other young child; and |
---|
31 | 31 | | (iv) the symptoms of shaken baby syndrome |
---|
32 | 32 | | and who to contact, as recommended by the American Academy of |
---|
33 | 33 | | Pediatrics, if a parent suspects or knows that a baby has been |
---|
34 | 34 | | shaken in order to receive prompt medical treatment; |
---|
35 | 35 | | (C) a list of diseases for which a child is |
---|
36 | 36 | | required by state law to be immunized and the appropriate schedule |
---|
37 | 37 | | for the administration of those immunizations; [and] |
---|
38 | 38 | | (D) the appropriate schedule for follow-up |
---|
39 | 39 | | procedures for newborn screening; and |
---|
40 | 40 | | (E) information regarding Sudden Infant Death |
---|
41 | 41 | | Syndrome, including current recommendations for infant sleeping |
---|
42 | 42 | | conditions to lower the risk of Sudden Infant Death Syndrome; |
---|
43 | 43 | | (2) document in the woman's record that the woman |
---|
44 | 44 | | received the information described in Subdivision (1); and |
---|
45 | 45 | | (3) retain the documentation for at least five years |
---|
46 | 46 | | in the hospital's, birthing center's, physician's, nurse midwife's, |
---|
47 | 47 | | or midwife's records. |
---|
48 | 48 | | SECTION 2. Not later than January 1, 2010, the Department of |
---|
49 | 49 | | State Health Services shall update the resource pamphlet on the |
---|
50 | 50 | | department's website to include the information about Sudden Infant |
---|
51 | 51 | | Death Syndrome required by Section 161.501, Health and Safety Code, |
---|
52 | 52 | | as amended by this Act. |
---|
53 | 53 | | SECTION 3. A hospital, birthing center, physician, nurse |
---|
54 | 54 | | midwife, or midwife who provides prenatal care to a pregnant woman |
---|
55 | 55 | | during gestation or at delivery of an infant is not required to |
---|
56 | 56 | | provide the updated brochure containing the information about |
---|
57 | 57 | | Sudden Infant Death Syndrome required by Section 161.501, Health |
---|
58 | 58 | | and Safety Code, as amended by this Act, before March 1, 2010. |
---|
59 | 59 | | SECTION 4. This Act takes effect September 1, 2009. |
