55 AN ACT
66 relating to access to rivers and riverbeds for individuals with
77 physical disabilities.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. This Act may be cited as the Matthew Dukes Act.
1010 SECTION 2. Section 90.003, Parks and Wildlife Code, is
1111 amended by amending Subsection (a) and adding Subsection (d) to
1212 read as follows:
1313 (a) Section 90.002 does not apply to:
1414 (1) a state, county, or municipal road right-of-way;
1515 (2) a private road crossing established on or before
1616 December 31, 2003; or
1717 (3) operation of a motor vehicle by:
1818 (A) a federal, state, or local government
1919 employee if operation of a motor vehicle is necessary for
2020 conducting official business;
2121 (B) a person if operation of a motor vehicle is
2222 necessary for reasonable purposes related to usual and customary
2323 agricultural activities;
2424 (C) a person if operation of a motor vehicle is
2525 necessary to and is authorized by a mineral lease;
2626 (D) a person if operation of a motor vehicle is
2727 necessary to and authorized by a crossing easement granted by the
2828 General Land Office under the Natural Resources Code;
2929 (E) a person if operation of a motor vehicle is
3030 necessary to an activity authorized by Chapter 86;
3131 (F) a person in response to an emergency;
3232 (G) a person if operation of a motor vehicle is
3333 necessary for the lawful construction, operation, or maintenance of
3434 equipment, facilities, or structures used for:
3535 (i) the production, transportation,
3636 transmission, or distribution of electric power;
3737 (ii) the provision of telecommunications
3838 services or other services delivered through a cable system;
3939 (iii) the transportation of aggregates,
4040 oil, natural gas, coal, or any product of oil, natural gas, or coal;
4141 (iv) the production, treatment, or
4242 transportation of water or wastewater; or
4343 (v) dredge material disposal placement;
4444 (H) an owner of the uplands adjacent to a
4545 protected freshwater area, the owner's agent, lessee, sublessee, or
4646 the lessee or sublessee's agent, representative, licensee,
4747 invitee, or guest for reasonable purposes related to usual and
4848 customary operation of:
4949 (i) a camp regulated under Chapter 141,
5050 Health and Safety Code; or
5151 (ii) a retreat facility owned and operated
5252 by a nonprofit corporation chartered under the laws of this state
5353 before January 1, 1970; [or]
5454 (I) an owner of the adjacent uplands on both
5555 sides of a protected freshwater area and the owner's agents,
5656 employees, representatives, and lessees only for the purpose of
5757 accessing the owner's property on the opposite side of the
5858 protected freshwater area when no reasonable alternate access is
5959 available; or
6060 (J) subject to Subsection (d), a person who has a
6161 permanent physical disability that substantially impairs one or
6262 more of the major life activities of the person.
6363 (d) A person described by Subsection (a)(3)(J):
6464 (1) must have in or on the motor vehicle used to access
6565 the protected freshwater area:
6666 (A) a disabled parking placard issued under
6767 Section 681.002, Transportation Code; or
6868 (B) a license plate issued under Section 504.201,
6969 Transportation Code;
7070 (2) must have in the person's possession a written
7171 statement from a licensed physician documenting the extent of the
7272 disability; and
7373 (3) may operate the motor vehicle used to access the
7474 protected freshwater area only:
7575 (A) on a part of the protected freshwater area
7676 that is not covered by water; and
7777 (B) for ingress to or egress from the protected
7878 freshwater area or, for the purpose of making a 180-degree turn for
7979 egress, within 100 feet upstream or downstream from the point of
8080 ingress.
8181 SECTION 3. This Act takes effect September 1, 2009.
