77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Chapter 418, Government Code, is amended by
99 adding Subchapter I to read as follows:
1010 SUBCHAPTER I. LOCAL PUBLIC HEALTH AND PUBLIC SAFETY ALERTS
1111 Sec. 418.190. DEFINITIONS. In this subchapter:
1212 (1) "Emergency management director" means a person
1313 designated to serve as emergency management director under Section
1414 418.1015.
1515 (2) "Health authority" has the meaning assigned by
1616 Section 81.003, Health and Safety Code.
1717 Sec. 418.191. LOCAL PUBLIC HEALTH AND PUBLIC SAFETY ALERTS.
1818 With the cooperation of the Texas Department of Transportation and
1919 emergency management directors, the division shall develop and
2020 implement a system for municipalities and counties to issue local
2121 public health and public safety alerts through an existing system
2222 of dynamic message signs. The local public health and public safety
2323 alerts may include public service messages provided to motorists:
2424 (1) during a severe weather advisory;
2525 (2) during an evacuation that has been ordered; or
2626 (3) following a declaration of a state of disaster
2727 issued under this chapter.
2828 Sec. 418.192. ADMINISTRATION. (a) The division shall
2929 coordinate the local public health and public safety alert system.
3030 (b) The division shall adopt standards as necessary to
3131 ensure proper implementation of the alert system. The standards
3232 must address:
3333 (1) the procedures to be used by a health authority to
3434 verify a threat to public health within the health authority's
3535 jurisdiction;
3636 (2) the procedures to be used by a local law
3737 enforcement agency to verify a threat to public safety within the
3838 agency's jurisdiction; and
3939 (3) the procedures to be used by an individual or
4040 entity to report information about a threat to public health or
4141 public safety.
4242 (c) The division shall prescribe forms for use by an
4343 emergency management director for a municipality or county in
4444 requesting activation of the alert system.
4545 Sec. 418.193. DUTIES OF TEXAS DEPARTMENT OF TRANSPORTATION.
4646 (a) The Texas Department of Transportation shall:
4747 (1) cooperate with the division and emergency
4848 management directors and assist in developing and implementing the
4949 alert system; and
5050 (2) establish a plan for providing relevant
5151 information to the public in affected areas of the state through an
5252 existing system of dynamic message signs.
5353 (b) The Texas Department of Transportation may coordinate
5454 the implementation of its duties under this subchapter with the
5555 implementation of the silver alert system under Subchapter M,
5656 Chapter 411.
5757 (c) The Texas Department of Transportation shall coordinate
5858 with the division to determine additional methods of disseminating
5959 local public health and safety alerts under Section 418.191, AMBER
6060 alerts under Subchapter L, Chapter 411, and silver alerts under
6161 Subchapter M, Chapter 411, using existing resources.
6262 Sec. 418.194. NOTIFICATION TO DIVISION OF LOCAL THREAT TO
6363 PUBLIC HEALTH OR PUBLIC SAFETY. (a) An emergency management
6464 director may notify the division if the emergency management
6565 director receives notice from:
6666 (1) a health authority of a verified threat to public
6767 health within the health authority's jurisdiction; or
6868 (2) a local law enforcement agency of a verified
6969 threat to public safety within the agency's jurisdiction.
7070 (b) The emergency management director must determine that
7171 the information provided by a health authority or a local law
7272 enforcement agency poses a credible threat to the municipality or
7373 county.
7474 Sec. 418.195. ACTIVATION. (a) On the request of an
7575 emergency management director, the division shall activate the
7676 alert system and notify appropriate participants in the alert
7777 system.
7878 (b) The division shall send the alert to designated media
7979 outlets in the area affected by the public health or public safety
8080 threat. Following receipt of the alert, participating media
8181 outlets may issue the alert at designated intervals.
8282 Sec. 418.196. CONTENT OF LOCAL PUBLIC HEALTH OR PUBLIC
8383 SAFETY ALERT. A local public health or public safety alert must
8484 include:
8585 (1) all appropriate information that is provided by
8686 the emergency management director; and
8787 (2) information on whom an individual in the affected
8888 area can contact for more information.
8989 Sec. 418.197. TERMINATION OF LOCAL PUBLIC HEALTH OR PUBLIC
9090 SAFETY ALERT. (a) The division shall terminate any activation of
9191 the alert with respect to a local public health or public safety
9292 alert not later than the earlier of the time at which:
9393 (1) the local public health or public safety threat is
9494 resolved; or
9595 (2) the notification period ends, as determined by
9696 standards adopted by the division.
9797 (b) An emergency management director that requests
9898 activation of the alert system under this subchapter shall notify
9999 the division as soon as possible that the local public health or
100100 public safety threat is resolved.
101101 SECTION 2. This Act takes effect September 1, 2009.
