55 relating to services for persons with autism and other pervasive
66 developmental disorders and their families.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Chapter 114, Human Resources Code, is amended by
99 adding Section 114.013 to read as follows:
1010 Sec. 114.013. AUTISM SPECTRUM DISORDERS RESOURCE CENTER.
1111 (a) The Health and Human Services Commission shall establish and
1212 administer an autism spectrum disorders resource center to
1313 coordinate resources for individuals with autism and other
1414 pervasive developmental disorders and their families. In
1515 establishing and administering the center, the Health and Human
1616 Services Commission shall consult with the council and coordinate
1717 with appropriate state agencies, including each agency represented
1818 on the council.
1919 (b) The Health and Human Services Commission shall design
2020 the center to:
2121 (1) collect and distribute information and research
2222 regarding autism and other pervasive developmental disorders;
2323 (2) conduct training and development activities for
2424 persons who may interact with an individual with autism or another
2525 pervasive developmental disorder in the course of their employment,
2626 including school, medical, or law enforcement personnel;
2727 (3) coordinate with local entities that provide
2828 services to an individual with autism or another pervasive
2929 developmental disorder; and
3030 (4) provide support for families affected by autism
3131 and other pervasive developmental disorders.
3232 SECTION 2. (a) The executive commissioner of the Health
3333 and Human Services Commission shall conduct a study to determine
3434 the costs and benefits to this state of initiating a pilot program
3535 to provide services to adult persons with autism and other related
3636 disabilities with similar support needs.
3737 (b) The study will determine the costs and benefits of a
3838 pilot program based on a program designed to:
3939 (1) encourage sustainable employment and community
4040 integration through specialized supports coordination, case
4141 management, vocational assessment, training, and support to
4242 increase job skills and competitive employment opportunities;
4343 (2) develop meaningful community-based activities for
4444 persons for whom competitive employment is not a goal;
4545 (3) promote continued individual development and
4646 avoid regression;
4747 (4) promote self-determination and independence;
4848 (5) coordinate services and behavioral supports
4949 across all areas of need; and
5050 (6) allow for flexible funding and for a flexible
5151 array of services to meet individual needs.
5252 (c) In conducting the study, the executive commissioner of
5353 the Health and Human Services Commission shall:
5454 (1) define and describe a pilot program with a
5555 seamless system of supports to provide:
5656 (A) options for independent living, if
5757 appropriate;
5858 (B) community-based housing, if needed; and
5959 (C) individualized supports, including:
6060 (i) prevocational training;
6161 (ii) employment training; and
6262 (iii) leisure and recreational activities;
6363 (2) research and analyze best practices and programs
6464 from other states that may serve as pilot program models;
6565 (3) consult with and solicit feedback from key
6666 stakeholders, including advocacy organizations, potential service
6767 recipients, and parents;
6868 (4) address the barriers that may prevent adults with
6969 autism or other related disabilities with similar support needs
7070 from living in their local community including:
7171 (A) housing needs and living arrangements;
7272 (B) behavioral services;
7373 (C) social and communication services and
7474 supports;
7575 (D) transportation issues; and
7676 (E) health and medical care;
7777 (5) identify the existence and cause of service gaps
7878 in this state;
7979 (6) develop recommendations and determine costs
8080 associated with eliminating service gaps;
8181 (7) identify the potential benefit to persons who
8282 would receive services from the pilot program; and
8383 (8) identify potential federal sources of funding for
8484 a pilot program.
8585 (d) Not later than September 1, 2010, the executive
8686 commissioner of the Health and Human Services Commission shall
8787 submit a report of the findings and conclusions of the study to the
8888 governor, the lieutenant governor, the speaker of the house of
8989 representatives, and the presiding officers of the standing
9090 committees of the senate and house of representatives with primary
9191 jurisdiction over the provision of services to persons with
9292 disabilities.
9393 (e) The report required under Subsection (d) of this section
9494 must include:
9595 (1) a recommendation for the structure of a pilot
9696 program;
9797 (2) a recommendation on the choice of an appropriate
9898 agency to design and administer a pilot program;
9999 (3) an estimation of the number of persons who may
100100 benefit from a pilot program if a program similar to the pilot
101101 program were instituted statewide;
102102 (4) an estimation of the potential costs of the pilot
103103 program and whether the pilot program may lead to savings;
104104 (5) a method of determining which persons would be
105105 eligible to participate in the pilot program; and
106106 (6) which Medicaid waiver programs are appropriate to
107107 the pilot program and whether new Medicaid waiver programs may be
108108 required.
109109 SECTION 3. This Act takes effect September 1, 2009.
