9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Sections 406.121(1) and (5), Labor Code, are | |
11 | 11 | amended to read as follows: | |
12 | 12 | (1) "General contractor" means a person who undertakes | |
13 | 13 | to procure the performance of work or a service for the benefit of | |
14 | 14 | another, either separately or through the use of subcontractors. | |
15 | 15 | The term includes a "principal contractor," "original contractor," | |
16 | 16 | "prime contractor," or other analogous term. The term does not | |
17 | 17 | include a motor carrier that provides a transportation service | |
18 | 18 | through the use of an owner operator. | |
19 | 19 | (5) "Subcontractor" means a person who contracts with | |
20 | 20 | a general contractor to perform all or any part of the work or | |
21 | 21 | services that the general contractor has contracted with another | |
22 | 22 | party [undertaken] to perform. | |
23 | 23 | SECTION 2. This Act takes effect immediately if it receives | |
24 | 24 | a vote of two-thirds of all the members elected to each house, as | |
25 | 25 | provided by Section 39, Article III, Texas Constitution. If this | |
26 | 26 | Act does not receive the vote necessary for immediate effect, this | |
27 | 27 | Act takes effect September 1, 2009. |
