| 14 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 15 | 15 | | SECTION 1. Section 232.041, Local Government Code, is |
|---|
| 16 | 16 | | amended by adding Subsection (e) to read as follows: |
|---|
| 17 | 17 | | (e) The commissioners court may impose a fee for an |
|---|
| 18 | 18 | | application under this section. The amount of the fee must be based |
|---|
| 19 | 19 | | on the cost of processing the application, including the notices |
|---|
| 20 | 20 | | required under Subsection (b) not to exceed one thousand five |
|---|
| 21 | 21 | | hundred dollars ($1,500.00). |

| 22 | 22 | | SECTION 2. The change in law made by this Act to Section |
|---|
| 23 | 23 | | 232.041, Local Government Code, applies only to an application |
|---|
| 24 | 24 | | filed on or after the effective date of this Act. |
|---|
| 25 | 25 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 29 | | Act takes effect September 1, 2009. |
