10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Section 541.201(24), Transportation Code, is | |
12 | 12 | amended to read as follows: | |
13 | 13 | (24) "Electric bicycle" means a bicycle that: | |
14 | 14 | (A) is designed to be propelled by an electric | |
15 | 15 | motor with a power output of 3,000 watts or less, exclusively or in | |
16 | 16 | combination with the application of human power; and | |
17 | 17 | (B) cannot attain a speed of more than 30 [20] | |
18 | 18 | miles per hour without the application of human power[; and | |
19 | 19 | [(C) does not exceed a weight of 100 pounds]. | |
20 | 20 | SECTION 2. This Act takes effect September 1, 2009. |
