77 relating to the definition of an electric bicycle for purposes
88 related to the use, registration, and licensing of electric

1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 541.201(24), Transportation Code, is
1212 amended to read as follows:
1313 (24) "Electric bicycle" means a bicycle that:
1414 (A) is designed to be propelled by an electric
1515 motor with a power output of 3,000 watts or less, exclusively or in
1616 combination with the application of human power; and
1717 (B) cannot attain a speed of more than 30 [20]
1818 miles per hour without the application of human power[; and
1919 [(C) does not exceed a weight of 100 pounds].
2020 SECTION 2. This Act takes effect September 1, 2009.
