 A BILL TO BE ENTITLED
 AN ACT
 relating to the definition of an electric bicycle for purposes
 related to the use, registration, and licensing of electric
 bicycles.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Section 541.201(24), Transportation Code, is
 amended to read as follows:
 (24) "Electric bicycle" means a bicycle that:
 (A) is designed to be propelled by an electric
 motor with a power output of 3,000 watts or less, exclusively or in
 combination with the application of human power; and
 (B) cannot attain a speed of more than 30 [20]
 miles per hour without the application of human power[; and
 [(C) does not exceed a weight of 100 pounds].
 SECTION 2. This Act takes effect September 1, 2009.
