8	8	AN ACT
9	9	relating to the required disclosure under the public information
10	10	law of information pertaining to an employee or trustee of a public
11	11	employee pension system.
12	12	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13	13	SECTION 1. Subchapter B, Chapter 552, Government Code, is
14	14	amended by adding Section 552.0221 to read as follows:
15	15	Sec. 552.0221. EMPLOYEE OR TRUSTEE OF PUBLIC EMPLOYEE
16	16	PENSION SYSTEM. (a) Information concerning the employment of an
17	17	employee of a public employee pension system is public information
18	18	under the terms of this chapter, including information concerning
19	19	the income, salary, benefits, and bonuses received from the pension
20	20	system by the employee in the person's capacity as an employee of
21	21	the system, and is not removed from the application of this chapter,
22	22	made confidential, or otherwise excepted from the requirements of
23	23	Section 552.021 by any statute intended to protect the records of
24	24	persons as members, beneficiaries, or retirees of a public employee
25	25	pension system in their capacity as such.
26	26	(b) Information concerning the service of a trustee of a
27	27	public employee pension system is public information under the
28	28	terms of this chapter, including information concerning the income,
29	29	salary, benefits, and bonuses received from the pension system by
30	30	the trustee in the person's capacity as a trustee of the system, and
31	31	is not removed from the application of this chapter, made
32	32	confidential, or otherwise excepted from the requirements of
33	33	Section 552.021 by any statute intended to protect the records of
34	34	persons as members, beneficiaries, or retirees of a public employee
35	35	pension system in their capacity as such.
36	36	(c) Information subject to Subsections (a) and (b) must be
37	37	released only to the extent the information is not excepted from
38	38	required disclosure under Subchapter C.
39	39	SECTION 2. Section 552.0221, Government Code, as added by
40	40	this Act, applies only in relation to a request for public
41	41	information made on or after the effective date of this Act.
42	42	SECTION 3. This Act takes effect immediately if it receives
43	43	a vote of two-thirds of all the members elected to each house, as
44	44	provided by Section 39, Article III, Texas Constitution. If this
45	45	Act does not receive the vote necessary for immediate effect, this
46	46	Act takes effect September 1, 2009.
