77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 113.2435, Natural Resources Code, is
99 amended by adding Subsection (d) to read as follows:
1010 (d) Notwithstanding Subsection (c)(5), the commission shall
1111 make available for rebates during a fiscal year the entire amount of
1212 money made available for rebates during the preceding fiscal year
1313 that was not spent during the preceding fiscal year. The amount of
1414 money made available for rebates during the preceding fiscal year
1515 that was not spent during the preceding fiscal year is not counted
1616 in determining the limitation on the proportion of the fund usable
1717 for the rebate program during a fiscal year.
1818 SECTION 2. This Act takes effect immediately if it receives
1919 a vote of two-thirds of all the members elected to each house, as
2020 provided by Section 39, Article III, Texas Constitution. If this
2121 Act does not receive the vote necessary for immediate effect, this
2222 Act takes effect September 1, 2009.
