77 relating to the formula funding for public institutions of higher
88 education for certain credit hours that do not count toward a
99 degree.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 61.0595(d), Education Code, is amended
1212 to read as follows:
1313 (d) The following are not counted for purposes of
1414 determining whether the student has previously earned the number of
1515 semester credit hours specified by Subsection (a):
1616 (1) semester credit hours earned by the student before
1717 receiving an associate or [a] baccalaureate degree that has
1818 previously been awarded to the student;
1919 (2) semester credit hours earned by the student by
2020 examination or under any other procedure by which credit is earned
2121 without registering for a course for which tuition is charged;
2222 (3) credit for a remedial education course, a
2323 technical course, a workforce education course funded according to
2424 contact hours, or another course that does not count toward a degree
2525 program at the institution; and
2626 (4) semester credit hours earned by the student at a
2727 private institution or an out-of-state institution.
2828 SECTION 2. The change in law made by this Act to Section
2929 61.0595, Education Code, applies beginning with the funding
3030 recommendations made under Section 61.059, Education Code, for the
3131 2011-2012 academic year.
3232 SECTION 3. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2009.
