66 AN ACT
77 relating to the criminal penalties and civil consequences for
88 defendants convicted of an offense of graffiti and for juveniles
99 adjudicated as having engaged in conduct involving graffiti.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Article 102.0171(a), Code of Criminal Procedure,
1212 is amended to read as follows:
1313 (a) A defendant convicted of an offense under Section 28.08,
1414 Penal Code, in a county court, county court at law, or district
1515 court shall pay a $100 [$50] juvenile delinquency prevention and
1616 graffiti eradication fee as a cost of court.
1717 SECTION 2. Section 54.046, Family Code, is amended by
1818 adding Subsection (d) to read as follows:
1919 (d) If on at least one previous occasion the child has been
2020 adjudicated as having engaged in conduct in violation of Section
2121 28.08, Penal Code, for which the child was placed on probation under
2222 Section 54.04(d), in addition to other conditions of probation, the
2323 court shall order the child to perform not less than 100 hours of
2424 community service.
2525 SECTION 3. Section 54.0461(a), Family Code, is amended to
2626 read as follows:
2727 (a) If a child is adjudicated as having engaged in
2828 delinquent conduct that violates Section 28.08, Penal Code, the
2929 juvenile court shall order the child, parent, or other person
3030 responsible for the child's support to pay to the court a $100 [$50]
3131 juvenile delinquency prevention fee as a cost of court.
3232 SECTION 4. Section 102.041, Government Code, as amended by
3333 Chapter 921 (H.B. 3167), Acts of the 80th Legislature, Regular
3434 Session, 2007, is amended to read as follows:
3535 Sec. 102.041. ADDITIONAL COURT COSTS ON CONVICTION IN
3636 DISTRICT COURT: CODE OF CRIMINAL PROCEDURE. The clerk of a
3737 district court shall collect fees and costs under the Code of
3838 Criminal Procedure on conviction of a defendant as follows:
3939 (1) a jury fee (Art. 102.004, Code of Criminal

156156 SECTION 8. Sections 28.08(b) and (d), Penal Code, are
157157 amended to read as follows:
158158 (b) Except as provided by Subsection (d), an offense under
159159 this section is:
160160 (1) a Class A [B] misdemeanor if the amount of
161161 pecuniary loss is less than $500;
162162 (2) a state jail felony [Class A misdemeanor] if the
163163 amount of pecuniary loss is $500 or more but less than $1,500;
164164 (3) a felony of the third degree [state jail felony] if
165165 the amount of pecuniary loss is $1,500 or more but less than
166166 $20,000;
167167 (4) a felony of the second [third] degree if the amount
168168 of pecuniary loss is $20,000 or more but less than $100,000; or
169169 (5) a felony of the first [second] degree if the amount
170170 of pecuniary loss is $100,000 or more [but less than $200,000; or
171171 [(6) a felony of the first degree if the amount of
172172 pecuniary loss is $200,000 or more].
173173 (d) An offense under this section is a [state jail] felony
174174 of the third degree if:
175175 (1) the marking is made on a school, an institution of
176176 higher education, a place of worship or human burial, a public
177177 monument, or a community center that provides medical, social, or
178178 educational programs; and
179179 (2) the amount of the pecuniary loss to real property
180180 or to tangible personal property is less than $20,000.
181181 SECTION 9. The change in law made by this Act applies only
182182 to an offense committed on or after the effective date of this Act.
183183 An offense committed before the effective date of this Act is
184184 covered by the law in effect when the offense was committed, and the
185185 former law is continued in effect for that purpose. For purposes of
186186 this section, an offense was committed before the effective date of
187187 this Act if any element of the offense was committed before that
188188 date.
189189 SECTION 10. This Act takes effect September 1, 2009.
