9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 771.001, Health and Safety Code, is | |
11 | 11 | amended by adding Subdivision (6-a) to read as follows: | |
12 | 12 | (6-a) "Prepaid wireless telecommunications device" | |
13 | 13 | means a mobile telephone, service, or SIM card for which access to | |
14 | 14 | wireless communication service is provided to a customer without | |
15 | 15 | the customer being required to enter into a credit account. | |
16 | 16 | SECTION 2. Section 771.0711, Health and Safety Code, is | |
17 | 17 | amended by adding Subsection (a-1) to read as follows: | |
18 | 18 | (a-1) Neither the commission nor a political subdivision | |
19 | 19 | may impose a fee on a prepaid wireless telecommunications device | |
20 | 20 | for 9-1-1 emergency service. | |
21 | 21 | SECTION 3. This Act takes effect immediately if it receives | |
22 | 22 | a vote of two-thirds of all the members elected to each house, as | |
23 | 23 | provided by Section 39, Article III, Texas Constitution. If this | |
24 | 24 | Act does not receive the vote necessary for immediate effect, this | |
25 | 25 | Act takes effect September 1, 2009. |
