66 AN ACT
77 relating to exempting prepaid wireless telecommunications devices
88 from the 9-1-1 emergency service fee.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 771.001, Health and Safety Code, is
1111 amended by adding Subdivision (6-a) to read as follows:
1212 (6-a) "Prepaid wireless telecommunications device"
1313 means a mobile telephone, service, or SIM card for which access to
1414 wireless communication service is provided to a customer without
1515 the customer being required to enter into a credit account.
1616 SECTION 2. Section 771.0711, Health and Safety Code, is
1717 amended by adding Subsection (a-1) to read as follows:
1818 (a-1) Neither the commission nor a political subdivision
1919 may impose a fee on a prepaid wireless telecommunications device
2020 for 9-1-1 emergency service.
2121 SECTION 3. This Act takes effect immediately if it receives
2222 a vote of two-thirds of all the members elected to each house, as
2323 provided by Section 39, Article III, Texas Constitution. If this
2424 Act does not receive the vote necessary for immediate effect, this
2525 Act takes effect September 1, 2009.
