 A BILL TO BE ENTITLED
 AN ACT
 relating to exempting prepaid wireless telecommunications devices
 from the 9-1-1 emergency service fee.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Section 771.001, Health and Safety Code, is
 amended by adding Subdivision (6-a) to read as follows:
 (6-a) "Prepaid wireless telecommunications device"
 means a mobile telephone, service, or SIM card for which access to
 wireless communication service is provided to a customer without
 the customer being required to enter into a credit account.
 SECTION 2. Section 771.0711, Health and Safety Code, is
 amended by adding Subsection (a-1) to read as follows:
 (a-1)  Neither the commission nor a political subdivision
 may impose a fee on a prepaid wireless telecommunications device
 for 9-1-1 emergency service.
 SECTION 3. This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution. If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2009.
