| 10 | 10 | SECTION 1. Subchapter C, Chapter 39, Utilities Code, is | |
| 11 | 11 | amended by adding Section 39.111 to read as follows: | |
| 12 | 12 | Sec. 39.111. NOTICE REGARDING CUSTOMER CHOICE INFORMATION. | |
| 13 | 13 | A retail electric provider shall include on a variable rate plan | |
| 14 | 14 | customer's bill: | |
| 15 | 15 | (1) a statement of the price of electric service, | |
| 16 | 16 | exclusive of taxes and nonrecurring charges or credits, expressed | |
| 17 | 17 | in terms of cents per kilowatt-hour rounded to the nearest | |
| 18 | 18 | one-tenth of one percent, for the current billing period and | |
| 19 | 19 | preceding billing period; | |
| 20 | 20 | (2) a statement of the estimated price of electric | |
| 21 | 21 | service, exclusive of taxes and nonrecurring charges or credits, | |
| 22 | 22 | expressed in terms of cents per kilowatt-hour rounded to the | |
| 23 | 23 | nearest one-tenth of one percent, for the upcoming billing period; | |
| 24 | 24 | and | |
| 25 | 25 | (3) a statement, in at least 14-point type on the front | |
| 26 | 26 | of the first page, that reads: "For more information about your | |
| 27 | 27 | electric service please visit www.powertochoose.com." | |
| 28 | 28 | SECTION 2. This Act takes effect September 1, 2009. |
