| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter A, Chapter 92, Property Code, is |
|---|
| 13 | 13 | | amended by adding Section 92.0132 to read as follows: |
|---|
| 14 | 14 | | Sec. 92.0132. NOTICE REGARDING RENTER'S INSURANCE. (a) |
|---|
| 15 | 15 | | Before entering into a lease with a tenant, a landlord or the |
|---|
| 16 | 16 | | landlord's agent shall give written notice to the tenant that is |
|---|
| 17 | 17 | | substantially equivalent to the following: |
|---|
| 18 | 18 | | The property owner's insurance cannot provide coverage for |
|---|
| 19 | 19 | | your personal property. You may purchase renter's insurance, which |
|---|
| 20 | 20 | | may cover losses due to theft, fire, or other events or occurrences. |
|---|
| 21 | 21 | | Renter's insurance may not cover losses due to a flood. |
|---|
| 22 | 22 | | (b) The notice must also include information on obtaining |
|---|
| 23 | 23 | | renter's insurance or include or attach contact information for a |
|---|
| 24 | 24 | | resource for information on obtaining renter's insurance. |
|---|
| 25 | 25 | | (c) The notice required by this section may be printed in |
|---|
| 26 | 26 | | the lease or in a separate document signed by the landlord or the |
|---|
| 27 | 27 | | landlord's agent and the tenant. |
|---|
| 28 | 28 | | SECTION 2. (a) The change in law made by this Act applies |
|---|
| 29 | 29 | | only to a lease initially entered into on or after January 1, 2010. |
|---|
| 30 | 30 | | (b) A lease initially entered into before January 1, 2010, |
|---|
| 31 | 31 | | is governed by the law existing immediately before the effective |
|---|
| 32 | 32 | | date of this Act, and that law is continued in effect for that |
|---|
| 33 | 33 | | purpose. |
|---|
| 34 | 34 | | (c) This Act does not apply to the renewal of a lease. |
|---|
| 35 | 35 | | SECTION 3. This Act takes effect January 1, 2010. |
