99 relating to notice to residential tenants regarding renter's
1010 insurance.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter A, Chapter 92, Property Code, is
1313 amended by adding Section 92.0132 to read as follows:
1414 Sec. 92.0132. NOTICE REGARDING RENTER'S INSURANCE. (a)
1515 Before entering into a lease with a tenant, a landlord or the
1616 landlord's agent shall give written notice to the tenant that is
1717 substantially equivalent to the following:
1818 The property owner's insurance cannot provide coverage for
1919 your personal property. You may purchase renter's insurance, which
2020 may cover losses due to theft, fire, or other events or occurrences.
2121 Renter's insurance may not cover losses due to a flood.
2222 (b) The notice must also include information on obtaining
2323 renter's insurance or include or attach contact information for a
2424 resource for information on obtaining renter's insurance.
2525 (c) The notice required by this section may be printed in
2626 the lease or in a separate document signed by the landlord or the
2727 landlord's agent and the tenant.
2828 SECTION 2. (a) The change in law made by this Act applies
2929 only to a lease initially entered into on or after January 1, 2010.
3030 (b) A lease initially entered into before January 1, 2010,
3131 is governed by the law existing immediately before the effective
3232 date of this Act, and that law is continued in effect for that
3333 purpose.
3434 (c) This Act does not apply to the renewal of a lease.
3535 SECTION 3. This Act takes effect January 1, 2010.
