9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 571.122, Government Code, is amended by | |
11 | 11 | adding Subsection (b-1) to read as follows: | |
12 | 12 | (b-1) An individual must be a registered voter of this state | |
13 | 13 | to be eligible to file a sworn complaint with the commission. The | |
14 | 14 | commission shall presume that an individual filing a sworn | |
15 | 15 | complaint is a registered voter of this state if a copy of the | |
16 | 16 | individual's voter registration certificate issued under Title 2, | |
17 | 17 | Election Code, is attached to the complaint. | |
18 | 18 | SECTION 2. Section 571.122(b-1), Government Code, as added | |
19 | 19 | by this Act, applies only to a sworn complaint filed with the Texas | |
20 | 20 | Ethics Commission on or after September 1, 2009. A sworn complaint | |
21 | 21 | filed with the Texas Ethics Commission before September 1, 2009, is | |
22 | 22 | governed by the law in effect on the date the complaint is filed. | |
23 | 23 | For purposes of this section, a sworn complaint that is resubmitted | |
24 | 24 | as provided by Section 571.123, Government Code, is considered to | |
25 | 25 | have been filed on the date the complaint was originally filed. | |
26 | 26 | SECTION 3. This Act takes effect September 1, 2009. |
