| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter B, Chapter 68, Water Code, is amended |
|---|
| 10 | 10 | | by adding Section 68.053 to read as follows: |
|---|
| 11 | 11 | | Sec. 68.053. USE OF CERTAIN DEPARTMENT OF TRANSPORTATION |
|---|
| 12 | 12 | | PROPERTY FOR SHIP CHANNEL SECURITY. (a) In this section, |
|---|
| 13 | 13 | | "department" means the Texas Department of Transportation. |
|---|
| 14 | 14 | | (b) Use of the department's facilities or property to serve |
|---|
| 15 | 15 | | a project aiding security in a ship channel security district |
|---|
| 16 | 16 | | created under this chapter serves a transportation purpose. A ship |
|---|
| 17 | 17 | | channel security district or a county whose commissioners court has |
|---|
| 18 | 18 | | created a ship channel security district may enter into an |
|---|
| 19 | 19 | | agreement with the department to provide for use of the |
|---|
| 20 | 20 | | department's facilities or property to aid security in the |
|---|
| 21 | 21 | | district. |
|---|
| 22 | 22 | | (c) A county that has entered into an agreement with the |
|---|
| 23 | 23 | | department for use of the department's fiber optic network for |
|---|
| 24 | 24 | | transportation purposes may use the fiber optic network to serve a |
|---|
| 25 | 25 | | project aiding security in a ship channel security district created |
|---|
| 26 | 26 | | under this chapter in the same manner as other transportation |
|---|
| 27 | 27 | | purposes unless the agreement precludes the use of the fiber optic |
|---|
| 28 | 28 | | network for that purpose. |
|---|
| 29 | 29 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 30 | 30 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 31 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 32 | 32 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 33 | 33 | | Act takes effect September 1, 2009. |
