77 relating to requirements for attorneys in fact under Lloyd's plans.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 941.101(b), Insurance Code, is amended
1010 to read as follows:
1111 (b) Except as otherwise provided by this chapter, an
1212 attorney in fact must:
1313 (1) be a resident of this state; [and]
1414 (2) maintain the attorney in fact's office in this
1515 state; and
1616 (3) be made a party to any suit brought to enforce the
1717 obligations of the Lloyd's plan under a contract of insurance.
1818 SECTION 2. The change in law made by this Act applies only
1919 to an insurance policy that is delivered, issued for delivery, or
2020 renewed on or after January 1, 2010. A policy delivered, issued for
2121 delivery, or renewed before January 1, 2010, is governed by the law
2222 as it existed immediately before the effective date of this Act, and
2323 that law is continued in effect for that purpose.
2424 SECTION 3. This Act takes effect September 1, 2009.
