8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Section 941.101(b), Insurance Code, is amended | |
10 | 10 | to read as follows: | |
11 | 11 | (b) Except as otherwise provided by this chapter, an | |
12 | 12 | attorney in fact must: | |
13 | 13 | (1) be a resident of this state; [and] | |
14 | 14 | (2) maintain the attorney in fact's office in this | |
15 | 15 | state; and | |
16 | 16 | (3) be made a party to any suit brought to enforce the | |
17 | 17 | obligations of the Lloyd's plan under a contract of insurance. | |
18 | 18 | SECTION 2. The change in law made by this Act applies only | |
19 | 19 | to an insurance policy that is delivered, issued for delivery, or | |
20 | 20 | renewed on or after January 1, 2010. A policy delivered, issued for | |
21 | 21 | delivery, or renewed before January 1, 2010, is governed by the law | |
22 | 22 | as it existed immediately before the effective date of this Act, and | |
23 | 23 | that law is continued in effect for that purpose. | |
24 | 24 | SECTION 3. This Act takes effect September 1, 2009. |
