55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to actions required to be taken by the Texas Education
88 Agency and a school district when the district fails to file its
99 annual audit report in a timely manner.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 44.008, Education Code, is amended by
1212 adding Subsection (d-2) to read as follows:
1313 (d-2) If a school district has not filed a copy of the school
1414 district's annual audit report in compliance with Subsection (d) by
1515 the 180th day after the date specified by that subsection:
1616 (1) the agency shall provide a written notification to
1717 the district that specifies the date on which the audit report was
1818 required by this section to be filed with the agency; and
1919 (2) the district shall:
2020 (A) if the district has an Internet website:
2121 (i) post a statement on the website
2222 informing interested persons that the district is more than six
2323 months late in filing the district's audit report as required by
2424 this section; and
2525 (ii) maintain the statement described by
2626 Subparagraph (i) on the website until the district files the
2727 district's audit report in compliance with this section; and
2828 (B) conduct a public meeting specifically for the
2929 purpose of:
3030 (i) publicizing, by reading into the record
3131 of the meeting, the notification received by the district from the
3232 agency under Subdivision (1); and
3333 (ii) discussing the date on which the
3434 district anticipates the audit report will be filed, as well as the
3535 reasons for the district's failure to comply with the filing
3636 requirement in a timely manner.
3737 SECTION 2. This Act takes effect immediately if it receives
3838 a vote of two-thirds of all the members elected to each house, as
3939 provided by Section 39, Article III, Texas Constitution. If this
4040 Act does not receive the vote necessary for immediate effect, this
4141 Act takes effect September 1, 2009.
