| 7 | 7 | | relating to actions required to be taken by the Texas Education |

| 8 | 8 | | Agency and a school district when the district fails to file its |
|---|
| 9 | 9 | | annual audit report in a timely manner. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 44.008, Education Code, is amended by |
|---|
| 12 | 12 | | adding Subsection (d-2) to read as follows: |
|---|
| 13 | 13 | | (d-2) If a school district has not filed a copy of the school |
|---|
| 14 | 14 | | district's annual audit report in compliance with Subsection (d) by |
|---|
| 15 | 15 | | the 180th day after the date specified by that subsection: |
|---|
| 16 | 16 | | (1) the agency shall provide a written notification to |
|---|
| 17 | 17 | | the district that specifies the date on which the audit report was |
|---|
| 18 | 18 | | required by this section to be filed with the agency; and |
|---|
| 19 | 19 | | (2) the district shall: |
|---|
| 20 | 20 | | (A) if the district has an Internet website: |
|---|
| 21 | 21 | | (i) post a statement on the website |
|---|
| 22 | 22 | | informing interested persons that the district is more than six |
|---|
| 23 | 23 | | months late in filing the district's audit report as required by |
|---|
| 24 | 24 | | this section; and |
|---|
| 25 | 25 | | (ii) maintain the statement described by |
|---|
| 26 | 26 | | Subparagraph (i) on the website until the district files the |
|---|
| 27 | 27 | | district's audit report in compliance with this section; and |
|---|
| 28 | 28 | | (B) conduct a public meeting specifically for the |
|---|
| 29 | 29 | | purpose of: |
|---|
| 30 | 30 | | (i) publicizing, by reading into the record |
|---|
| 31 | 31 | | of the meeting, the notification received by the district from the |
|---|
| 32 | 32 | | agency under Subdivision (1); and |
|---|
| 33 | 33 | | (ii) discussing the date on which the |
|---|
| 34 | 34 | | district anticipates the audit report will be filed, as well as the |
|---|
| 35 | 35 | | reasons for the district's failure to comply with the filing |
|---|
| 36 | 36 | | requirement in a timely manner. |
|---|
| 37 | 37 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 38 | 38 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 39 | 39 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 40 | 40 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 41 | 41 | | Act takes effect September 1, 2009. |
