 A BILL TO BE ENTITLED
 AN ACT
 relating to actions required to be taken by the Texas Education
 Agency and a school district when the district fails to file its
 annual audit report in a timely manner.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Section 44.008, Education Code, is amended by
 adding Subsection (d-2) to read as follows:
 (d-2)  If a school district has not filed a copy of the school
 district's annual audit report in compliance with Subsection (d) by
 the 180th day after the date specified by that subsection:
 (1)  the agency shall provide a written notification to
 the district that specifies the date on which the audit report was
 required by this section to be filed with the agency; and
 (2) the district shall:
 (A) if the district has an Internet website:
 (i)  post a statement on the website
 informing interested persons that the district is more than six
 months late in filing the district's audit report as required by
 this section; and
 (ii)  maintain the statement described by
 Subparagraph (i) on the website until the district files the
 district's audit report in compliance with this section; and
 (B)  conduct a public meeting specifically for the
 purpose of:
 (i)  publicizing, by reading into the record
 of the meeting, the notification received by the district from the
 agency under Subdivision (1); and
 (ii)  discussing the date on which the
 district anticipates the audit report will be filed, as well as the
 reasons for the district's failure to comply with the filing
 requirement in a timely manner.
 SECTION 2. This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution. If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2009.
