55 relating to the applicability of certain city requirements

88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 251.005, Agriculture Code, is amended by
1010 adding Subsection (c-2) to read as follows:
1111 (c-2) A governmental requirement of a city relating to the
1212 restraint of a dog that would apply to an agricultural operation
1313 under Subsection (c) does not apply to a dog used to protect
1414 livestock on property controlled by the property owner while the
1515 dog is being used on such property for that purpose.
1616 SECTION 2. This Act takes effect immediately if it receives
1717 a vote of two-thirds of all the members elected to each house, as
1818 provided by Section 39, Article III, Texas Constitution. If this
1919 Act does not receive the vote necessary for immediate effect, this
2020 Act takes effect September 1, 2009.
