| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter G, Chapter 1551, Insurance Code, is |
|---|
| 12 | 12 | | amended by adding Section 1551.3111 to read as follows: |
|---|
| 13 | 13 | | Sec. 1551.3111. AMOUNT OF STATE CONTRIBUTION FOR CERTAIN |
|---|
| 14 | 14 | | JUNIOR COLLEGE EMPLOYEES. (a) In determining the amount to be |
|---|
| 15 | 15 | | certified under Section 1551.311, the board of trustees shall |
|---|
| 16 | 16 | | include eligible public junior college employees. |
|---|
| 17 | 17 | | (b) For purposes of this section, a public junior college |
|---|
| 18 | 18 | | employee is eligible if the employee is: |
|---|
| 19 | 19 | | (1) otherwise eligible to participate in the group |
|---|
| 20 | 20 | | benefits program; and |
|---|
| 21 | 21 | | (2) an instructional or administrative employee whose |
|---|
| 22 | 22 | | salary may be fully paid from funds appropriated under the General |
|---|
| 23 | 23 | | Appropriations Act, regardless of whether the salary is actually |
|---|
| 24 | 24 | | paid from appropriated funds. |
|---|
| 25 | 25 | | (c) In determining the amount described in Subsection (a), |
|---|
| 26 | 26 | | the number of eligible employees included for each college in each |
|---|
| 27 | 27 | | biennium shall be adjusted in proportion to the change in student |
|---|
| 28 | 28 | | enrollment at each college during the reporting period, except that |
|---|
| 29 | 29 | | a college that experiences a decline in student enrollment may |
|---|
| 30 | 30 | | petition to maintain the number of eligible employees at the same |
|---|
| 31 | 31 | | level as the prior biennium. |
|---|
| 32 | 32 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 33 | 33 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 34 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 35 | 35 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 36 | 36 | | Act takes effect September 1, 2009. |
