88 AN ACT
99 relating to authorizing certain brewers and manufacturers to
1010 conduct tours of their premises after which beer or ale is provided
1111 to ultimate consumers for off-premises consumption.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Chapter 12, Alcoholic Beverage Code, is amended
1414 by adding Section 12.07 to read as follows:
1515 Sec. 12.07. TOUR OF PERMITTED PREMISES. (a) The holder of
1616 a brewer's permit may give tours of the brewery premises and may
1717 charge an admission fee for the tour.
1818 (b) The holder of a brewer's permit whose annual production
1919 of ale in this state does not exceed, together with the annual
2020 production of beer by the holder of a manufacturer's license under
2121 Section 62.15 at the same premises, a total of 250,000 barrels may,
2222 at the end of a tour of the brewery premises, give ale to tour
2323 participants in unbroken packages for off-premises consumption
2424 without an additional charge.
2525 (c) The total amount of ale a tour participant may receive
2626 in a single day under this section, together with the amount of beer
2727 the tour participant receives under Section 62.15 at the same
2828 premises, may not exceed 48 12-ounce bottles.
2929 (d) This section does not authorize the holder of a brewer's
3030 permit to sell ale to an ultimate consumer.
3131 SECTION 2. Chapter 62, Alcoholic Beverage Code, is amended
3232 by adding Section 62.15 to read as follows:
3333 Sec. 62.15. TOUR OF LICENSED PREMISES. (a) The holder of a
3434 manufacturer's license may give tours of the manufacturer's
3535 premises and may charge an admission fee for the tour.
3636 (b) The holder of a manufacturer's license whose annual
3737 production of beer in this state does not exceed, together with the
3838 annual production of ale by the holder of a brewer's permit under
3939 Section 12.07 at the same premises, a total of 250,000 barrels may,
4040 at the end of a tour of the manufacturer's premises, give beer to
4141 tour participants in unbroken packages for off-premises
4242 consumption without an additional charge.
4343 (c) The total amount of beer a tour participant may receive
4444 in a single day under this section, together with the amount of ale
4545 the tour participant receives under Section 12.07 at the same
4646 premises, may not exceed 48 12-ounce bottles.
4747 (d) This section does not authorize the holder of a
4848 manufacturer's license to sell beer to an ultimate consumer.
4949 SECTION 3. This Act takes effect immediately if it receives
5050 a vote of two-thirds of all the members elected to each house, as
5151 provided by Section 39, Article III, Texas Constitution. If this
5252 Act does not receive the vote necessary for immediate effect, this
5353 Act takes effect September 1, 2009.
