| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 662, Government Code, is |
|---|
| 11 | 11 | | amended by adding Section 662.014 to read as follows: |
|---|
| 12 | 12 | | Sec. 662.014. OPTIONAL HOLIDAY FOR WILLIE VELASQUEZ DAY. |
|---|
| 13 | 13 | | (a) The 9th day of May shall be designated "Willie Velasquez Day" |
|---|
| 14 | 14 | | in observance of the birthday of William "Willie" Cardenas |
|---|
| 15 | 15 | | Velasquez. |
|---|
| 16 | 16 | | (b) The administrative head of a state agency may allow an |
|---|
| 17 | 17 | | employee of the agency to have a day off with pay on Willie |
|---|
| 18 | 18 | | Velasquez Day in lieu of any other state holiday that occurs on a |
|---|
| 19 | 19 | | weekday, other than a weekday on which an election is held |
|---|
| 20 | 20 | | throughout the state, on which the state agency is required to be |
|---|
| 21 | 21 | | open but on which the operations of the agency are required to be |
|---|
| 22 | 22 | | maintained at only a minimum level. |
|---|
| 23 | 23 | | (c) On Willie Velasquez Day, each state agency shall remain |
|---|
| 24 | 24 | | open and conduct the operations of the agency at a minimum level. |
|---|
| 25 | 25 | | (d) A holiday allowed under this section is in lieu of |
|---|
| 26 | 26 | | another holiday prescribed by law. The total number of holidays in |
|---|
| 27 | 27 | | a year to which an employee of a state agency is entitled is not |
|---|
| 28 | 28 | | changed by this section. |
|---|
| 29 | 29 | | SECTION 2. This Act takes effect September 1, 2009. |
