99 relating to the creation of the Fort Bend County Water Control and
1010 Improvement District No. 10; providing authority to impose a tax
1111 and issue bonds; granting a limited power of eminent domain.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subtitle I, Title 6, Special District Local Laws
1414 Code, is amended by adding Chapter 9034 to read as follows:
1515 CHAPTER 9034. FORT BEND COUNTY WATER CONTROL AND IMPROVEMENT
1616 DISTRICT NO. 10
1717 SUBCHAPTER A. GENERAL PROVISIONS
1818 Sec. 9034.001. DEFINITIONS. In this chapter:
1919 (1) "Board" means the district's board of directors.
2020 (2) "Director" means a board member.
2121 (3) "District" means the Fort Bend County Water
2222 Control and Improvement District No. 10.
2323 Sec. 9034.002. NATURE OF DISTRICT. The district is a water
2424 control and improvement district created under Section 59, Article
2525 XVI, Texas Constitution.
2626 Sec. 9034.003. CONFIRMATION AND DIRECTORS' ELECTION
2727 REQUIRED. The temporary directors shall hold an election to
2828 confirm the creation of the district and to elect five permanent
2929 directors as provided by Section 49.102, Water Code.
3030 Sec. 9034.004. CONSENT OF MUNICIPALITY REQUIRED. The
3131 temporary directors may not hold an election under Section 9034.003
3232 until each municipality in whose corporate limits or
3333 extraterritorial jurisdiction the district is located has
3434 consented by ordinance or resolution to the creation of the
3535 district and to the inclusion of land in the district.
3636 Sec. 9034.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT. (a)
3737 The district is created to serve a public purpose and benefit.
3838 (b) The district is created to accomplish the purposes of:
3939 (1) a water control and improvement district as
4040 provided by general law and Section 59, Article XVI, Texas
4141 Constitution; and
4242 (2) Section 52, Article III, Texas Constitution, that
4343 relate to the construction, acquisition, improvement, operation,
4444 or maintenance of macadamized, graveled, or paved roads, or
4545 improvements, including storm drainage, in aid of those roads.
4646 Sec. 9034.006. INITIAL DISTRICT TERRITORY. (a) The
4747 district is initially composed of the territory described by
4848 Section 2 of the Act creating this chapter.
4949 (b) The boundaries and field notes contained in Section 2 of
5050 the Act creating this chapter form a closure. A mistake made in the
5151 field notes or in copying the field notes in the legislative process
5252 does not affect the district's:
5353 (1) organization, existence, or validity;
5454 (2) right to issue any type of bond for the purposes
5555 for which the district is created or to pay the principal of and
5656 interest on a bond;
5757 (3) right to impose a tax; or
5858 (4) legality or operation.

6060 SUBCHAPTER B. BOARD OF DIRECTORS
6161 Sec. 9034.051. GOVERNING BODY; TERMS. (a) The district is
6262 governed by a board of five elected directors.
6363 (b) Except as provided by Section 9034.052, directors serve
6464 staggered four-year terms.
6565 Sec. 9034.052. TEMPORARY DIRECTORS. (a) The temporary
6666 board consists of:
6767 (1) Jay Henry;
6868 (2) Mark Schindler;
6969 (3) David Vercellino;
7070 (4) Chris Sitka; and
7171 (5) Chrystal Seymour.
7272 (b) Temporary directors serve until the earlier of:
7373 (1) the date permanent directors are elected under
7474 Section 9034.003; or
7575 (2) the fourth anniversary of the effective date of
7676 the Act creating this chapter.
7777 (c) If permanent directors have not been elected under
7878 Section 9034.003 and the terms of the temporary directors have
7979 expired, successor temporary directors shall be appointed or
8080 reappointed as provided by Subsection (d) to serve terms that
8181 expire on the earlier of:
8282 (1) the date permanent directors are elected under
8383 Section 9034.003; or
8484 (2) the fourth anniversary of the date of the
8585 appointment or reappointment.
8686 (d) If Subsection (c) applies, the owner or owners of a
8787 majority of the assessed value of the real property in the district
8888 may submit a petition to the Texas Commission on Environmental
8989 Quality requesting that the commission appoint as successor
9090 temporary directors the five persons named in the petition. The
9191 commission shall appoint as successor temporary directors the five
9292 persons named in the petition.

9494 SUBCHAPTER C. POWERS AND DUTIES
9595 Sec. 9034.101. GENERAL POWERS AND DUTIES. The district has
9696 the powers and duties necessary to accomplish the purposes for
9797 which the district is created.
9898 Sec. 9034.102. WATER CONTROL AND IMPROVEMENT DISTRICT
9999 POWERS AND DUTIES. The district has the powers and duties provided
100100 by the general law of this state, including Chapters 49 and 51,
101101 Water Code, applicable to water control and improvement districts
102102 created under Section 59, Article XVI, Texas Constitution.
103103 Sec. 9034.103. AUTHORITY FOR ROAD PROJECTS. Under Section
104104 52, Article III, Texas Constitution, the district may design,
105105 acquire, construct, finance, issue bonds for, improve, operate,
106106 maintain, and convey to this state, a county, or a municipality for
107107 operation and maintenance macadamized, graveled, or paved roads, or
108108 improvements, including storm drainage, in aid of those roads.
109109 Sec. 9034.104. ROAD STANDARDS AND REQUIREMENTS. (a) A road
110110 project must meet all applicable construction standards, zoning and
111111 subdivision requirements, and regulations of each municipality in
112112 whose corporate limits or extraterritorial jurisdiction the road
113113 project is located.
114114 (b) If a road project is not located in the corporate limits
115115 or extraterritorial jurisdiction of a municipality, the road
116116 project must meet all applicable construction standards,
117117 subdivision requirements, and regulations of each county in which
118118 the road project is located.
119119 (c) If the state will maintain and operate the road, the
120120 Texas Transportation Commission must approve the plans and
121121 specifications of the road project.
122122 Sec. 9034.105. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
123123 OR RESOLUTION. The district shall comply with all applicable
124124 requirements of any ordinance or resolution that is adopted under
125125 Section 42.042, Local Government Code, and that consents to the
126126 creation of the district or to the inclusion of land in the
127127 district.
128128 Sec. 9034.106. LIMITATION ON USE OF EMINENT DOMAIN. The
129129 district may not exercise the power of eminent domain outside the
130130 district to acquire a site or easement for:
131131 (1) a road project authorized by Section 9034.103; or
132132 (2) a recreational facility as defined by Section
133133 49.462, Water Code.
134134 Sec. 9034.107. FIRE DEPARTMENTS. (a) The district may
135135 contract with the City of Richmond to perform firefighting services
136136 in the district on the same terms that the municipality provides
137137 firefighting services in the extraterritorial jurisdiction of the
138138 municipality. The district, with voter approval, may issue bonds
139139 payable from ad valorem taxes to pay for capital costs required
140140 under the contract, including:
141141 (1) the construction and purchase of facilities, land,
142142 and equipment; and
143143 (2) the provision of adequate water supply.
144144 (b) Notwithstanding Sections 49.351(g), (h), and (i), Water
145145 Code, if the district contracts with the City of Richmond to provide
146146 firefighting services in the district, the district is not required
147147 to submit a fire plan to the Texas Commission on Environmental
148148 Quality for approval.

150150 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
151151 Sec. 9034.151. ELECTIONS REGARDING TAXES OR BONDS. (a) The
152152 district may issue, without an election, bonds and other
153153 obligations secured by:
154154 (1) revenue other than ad valorem taxes; or
155155 (2) contract payments described by Section 9034.153.
156156 (b) The district must hold an election in the manner
157157 provided by Chapters 49 and 51, Water Code, to obtain voter approval
158158 before the district may impose an ad valorem tax or issue bonds
159159 payable from ad valorem taxes.
160160 (c) The district may not issue bonds payable from ad valorem
161161 taxes to finance a road project unless the issuance is approved by a
162162 vote of a two-thirds majority of the district voters voting at an
163163 election held for that purpose.
164164 Sec. 9034.152. OPERATION AND MAINTENANCE TAX. (a) If
165165 authorized at an election held under Section 9034.151, the district
166166 may impose an operation and maintenance tax on taxable property in
167167 the district in accordance with Section 49.107, Water Code.
168168 (b) The board shall determine the tax rate. The rate may not
169169 exceed the rate approved at the election.
170170 Sec. 9034.153. CONTRACT TAXES. (a) In accordance with
171171 Section 49.108, Water Code, the district may impose a tax other than
172172 an operation and maintenance tax and use the revenue derived from
173173 the tax to make payments under a contract after the provisions of
174174 the contract have been approved by a majority of the district voters
175175 voting at an election held for that purpose.
176176 (b) A contract approved by the district voters may contain a
177177 provision stating that the contract may be modified or amended by
178178 the board without further voter approval.

180180 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
181181 Sec. 9034.201. AUTHORITY TO ISSUE BONDS AND OTHER
182182 OBLIGATIONS. The district may issue bonds or other obligations
183183 payable wholly or partly from ad valorem taxes, impact fees,
184184 revenue, contract payments, grants, or other district money, or any
185185 combination of those sources, to pay for any authorized district
186186 purpose.
187187 Sec. 9034.202. TAXES FOR BONDS. At the time the district
188188 issues bonds payable wholly or partly from ad valorem taxes, the
189189 board shall provide for the annual imposition of a continuing
190190 direct ad valorem tax, without limit as to rate or amount, while all
191191 or part of the bonds are outstanding as required and in the manner
192192 provided by Section 51.433, Water Code.
193193 Sec. 9034.203. BONDS FOR ROAD PROJECTS. At the time of
194194 issuance, the total principal amount of bonds or other obligations
195195 issued or incurred to finance road projects and payable from ad
196196 valorem taxes may not exceed one-fourth of the assessed value of the
197197 real property in the district.
198198 SECTION 2. The Fort Bend County Water Control and
199199 Improvement District No. 10 initially includes all the territory
200200 contained in the following area:
201201 TRACT 1
202202 BEING a 150.22 acre tract of land situated in the Knight &
203203 White League, Abstract Number 46, Fort Bend County, Texas and being
204204 all of the following tracts of land; a called 42.00 acre tract of
205205 land described in an instrument filed for record under Fort Bend
206206 County Clerk's File Number (F.B.C.C.F. No.) 2007072919, a called
207207 4.248 acre tract of land described in an instrument filed for record
208208 under F.B.C.C.F. No. 2007151784, a called 103.97 acre tract
209209 described and recorded under F.B.C.C.F. No. 2007151785, said 150.22
210210 acre tract of land being more particularly described by metes and
211211 bounds as follows:
212212 Bearing orientation is based on the Texas State Plane
213213 Coordinate System, South Central Zone, NAD83.
214214 BEGINNING at a 1-inch iron pipe (disturbed) found for the
215215 northeast corner of said 42.00 acre tract and being in the south

370370 common to said 2.6207 acre tract and said 1.977 acre tract to the
371371 POINT OF BEGINNING and containing 2.813 acres of land.
372372 SECTION 3. (a) The legal notice of the intention to
373373 introduce this Act, setting forth the general substance of this
374374 Act, has been published as provided by law, and the notice and a
375375 copy of this Act have been furnished to all persons, agencies,
376376 officials, or entities to which they are required to be furnished
377377 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
378378 Government Code.
379379 (b) The governor, one of the required recipients, has
380380 submitted the notice and Act to the Texas Commission on
381381 Environmental Quality.
382382 (c) The Texas Commission on Environmental Quality has filed
383383 its recommendations relating to this Act with the governor, the
384384 lieutenant governor, and the speaker of the house of
385385 representatives within the required time.
386386 (d) All requirements of the constitution and laws of this
387387 state and the rules and procedures of the legislature with respect
388388 to the notice, introduction, and passage of this Act are fulfilled
389389 and accomplished.
390390 SECTION 4. This Act takes effect immediately if it receives
391391 a vote of two-thirds of all the members elected to each house, as
392392 provided by Section 39, Article III, Texas Constitution. If this
393393 Act does not receive the vote necessary for immediate effect, this
394394 Act takes effect September 1, 2009.
