66 AN ACT
77 relating to written notice to parents of certain amendments to
88 school district student codes of conduct.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 37.001(d), Education Code, is amended to
1111 read as follows:
1212 (d) Each school year, a school district shall provide
1313 parents notice of and information regarding the student code of
1414 conduct. As part of or in addition to the annual notice, the
1515 district shall provide parents written notice and information
1616 regarding any change or amendment to the student code of conduct as
1717 soon as practicable after the change or amendment is adopted if the
1818 change or amendment could result in:
1919 (1) a student's suspension from school, removal from
2020 class and placement in a disciplinary alternative education center,
2121 or expulsion under this chapter;
2222 (2) a finding under Section 54.03, Family Code, that
2323 the student has engaged in conduct indicating a need for
2424 supervision; or
2525 (3) the imposition of a criminal penalty.
2626 SECTION 2. This Act applies beginning with the 2009-2010
2727 school year.
2828 SECTION 3. This Act takes effect immediately if it receives
2929 a vote of two-thirds of all the members elected to each house, as
3030 provided by Section 39, Article III, Texas Constitution. If this
3131 Act does not receive the vote necessary for immediate effect, this
3232 Act takes effect September 1, 2009.
