7 | 7 | | relating to written notice to parents of certain amendments to |

8 | 8 | | school district student codes of conduct. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 37.001(d), Education Code, is amended to |
---|
11 | 11 | | read as follows: |
---|
12 | 12 | | (d) Each school year, a school district shall provide |
---|
13 | 13 | | parents notice of and information regarding the student code of |
---|
14 | 14 | | conduct. As part of or in addition to the annual notice, the |
---|
15 | 15 | | district shall provide parents written notice and information |
---|
16 | 16 | | regarding any change or amendment to the student code of conduct as |
---|
17 | 17 | | soon as practicable after the change or amendment is adopted if the |
---|
18 | 18 | | change or amendment could result in: |
---|
19 | 19 | | (1) a student's suspension from school, removal from |
---|
20 | 20 | | class and placement in a disciplinary alternative education center, |
---|
21 | 21 | | or expulsion under this chapter; |
---|
22 | 22 | | (2) a finding under Section 54.03, Family Code, that |
---|
23 | 23 | | the student has engaged in conduct indicating a need for |
---|
24 | 24 | | supervision; or |
---|
25 | 25 | | (3) the imposition of a criminal penalty. |
---|
26 | 26 | | SECTION 2. This Act applies beginning with the 2009-2010 |
---|
27 | 27 | | school year. |
---|
28 | 28 | | SECTION 3. This Act takes effect immediately if it receives |
---|
29 | 29 | | a vote of two-thirds of all the members elected to each house, as |
---|
30 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
31 | 31 | | Act does not receive the vote necessary for immediate effect, this |
---|
32 | 32 | | Act takes effect September 1, 2009. |
