 A BILL TO BE ENTITLED
 AN ACT
 relating to written notice to parents of certain amendments to
 school district student codes of conduct.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Section 37.001(d), Education Code, is amended to
 read as follows:
 (d) Each school year, a school district shall provide
 parents notice of and information regarding the student code of
 conduct. As part of or in addition to the annual notice, the
 district shall provide parents written notice and information
 regarding any change or amendment to the student code of conduct as
 soon as practicable after the change or amendment is adopted if the
 change or amendment could result in:
 (1)  a student's suspension from school, removal from
 class and placement in a disciplinary alternative education center,
 or expulsion under this chapter;
 (2)  a finding under Section 54.03, Family Code, that
 the student has engaged in conduct indicating a need for
 supervision; or
 (3) the imposition of a criminal penalty.
 SECTION 2. This Act applies beginning with the 2009-2010
 school year.
 SECTION 3. This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution. If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2009.
