55 relating to the public transportation advisory committee.
66 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
77 SECTION 1. Sections 455.004(a), (b), and (c),
88 Transportation Code, are amended to read as follows:
99 (a) A public transportation advisory committee consisting
1010 of nine [11] members shall:
1111 (1) advise the commission on the needs and problems of
1212 the state's public transportation providers, including the methods
1313 for allocating state public transportation money;
1414 (2) comment on rules involving public transportation
1515 during development of the rules and before the commission finally
1616 adopts the rules unless an emergency requires immediate commission
1717 action;
1818 (3) advise the commission on the implementation of
1919 Chapter 461; [and]
2020 (4) perform any other duty determined by the
2121 commission; and
2222 (5) reflect the diversity of the state.
2323 (b) The members [commission shall appoint members of the
2424 advisory committee. The membership] of the committee shall be
2525 appointed by the governor, the lieutenant governor, and the speaker
2626 of the house of representatives, who shall each appoint [include]:
2727 (1) one member [four members] who represents
2828 [represent] a diverse cross-section of public transportation
2929 providers;
3030 (2) one member [three members] who represents
3131 [represent] a diverse cross-section of transportation users; and
3232 (3) one member [three members] who represents
3333 [represent] the general public[; and
3434 [(4) one member with experience in the administration
3535 of health and human services programs].
3636 (c) A member serves at the pleasure of the officer who
3737 appointed the member [commission]. A member is not entitled to
3838 compensation for service on the committee but is entitled to
3939 reimbursement for reasonable expenses the member incurs in
4040 performing committee duties.
4141 SECTION 2. The change in law made by this Act to the public
4242 transportation advisory committee does not affect the entitlement
4343 of a member serving on the committee immediately before the
4444 effective date of this Act to serve the remainder of the member's
4545 term. The first two members whose positions expire or become vacant
4646 may not be replaced.
4747 SECTION 3. This Act takes effect September 1, 2009.
