| 5 | 5 | | relating to the public transportation advisory committee. |

| 6 | 6 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 7 | 7 | | SECTION 1. Sections 455.004(a), (b), and (c), |
|---|
| 8 | 8 | | Transportation Code, are amended to read as follows: |
|---|
| 9 | 9 | | (a) A public transportation advisory committee consisting |
|---|
| 10 | 10 | | of nine [11] members shall: |
|---|
| 11 | 11 | | (1) advise the commission on the needs and problems of |
|---|
| 12 | 12 | | the state's public transportation providers, including the methods |
|---|
| 13 | 13 | | for allocating state public transportation money; |
|---|
| 14 | 14 | | (2) comment on rules involving public transportation |
|---|
| 15 | 15 | | during development of the rules and before the commission finally |
|---|
| 16 | 16 | | adopts the rules unless an emergency requires immediate commission |
|---|
| 17 | 17 | | action; |
|---|
| 18 | 18 | | (3) advise the commission on the implementation of |
|---|
| 19 | 19 | | Chapter 461; [and] |
|---|
| 20 | 20 | | (4) perform any other duty determined by the |
|---|
| 21 | 21 | | commission; and |
|---|
| 22 | 22 | | (5) reflect the diversity of the state. |
|---|
| 23 | 23 | | (b) The members [commission shall appoint members of the |
|---|
| 24 | 24 | | advisory committee. The membership] of the committee shall be |
|---|
| 25 | 25 | | appointed by the governor, the lieutenant governor, and the speaker |
|---|
| 26 | 26 | | of the house of representatives, who shall each appoint [include]: |
|---|
| 27 | 27 | | (1) one member [four members] who represents |
|---|
| 28 | 28 | | [represent] a diverse cross-section of public transportation |
|---|
| 29 | 29 | | providers; |
|---|
| 30 | 30 | | (2) one member [three members] who represents |
|---|
| 31 | 31 | | [represent] a diverse cross-section of transportation users; and |
|---|
| 32 | 32 | | (3) one member [three members] who represents |
|---|
| 33 | 33 | | [represent] the general public[; and |
|---|
| 34 | 34 | | [(4) one member with experience in the administration |
|---|
| 35 | 35 | | of health and human services programs]. |
|---|
| 36 | 36 | | (c) A member serves at the pleasure of the officer who |
|---|
| 37 | 37 | | appointed the member [commission]. A member is not entitled to |
|---|
| 38 | 38 | | compensation for service on the committee but is entitled to |
|---|
| 39 | 39 | | reimbursement for reasonable expenses the member incurs in |
|---|
| 40 | 40 | | performing committee duties. |
|---|
| 41 | 41 | | SECTION 2. The change in law made by this Act to the public |
|---|
| 42 | 42 | | transportation advisory committee does not affect the entitlement |
|---|
| 43 | 43 | | of a member serving on the committee immediately before the |
|---|
| 44 | 44 | | effective date of this Act to serve the remainder of the member's |
|---|
| 45 | 45 | | term. The first two members whose positions expire or become vacant |
|---|
| 46 | 46 | | may not be replaced. |
|---|
| 47 | 47 | | SECTION 3. This Act takes effect September 1, 2009. |
