77 relating to an emergency management plan for certain health care
88 facilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 418, Government Code, is
1111 amended by adding Section 418.049 to read as follows:
1212 Sec. 418.049. EMERGENCY MANAGEMENT PLAN FOR CERTAIN HEALTH
1313 CARE FACILITIES. (a) The division shall review each emergency
1414 management plan submitted under Sections 242.018, 246.008, and
1515 247.007, Health and Safety Code, and suggest changes to a plan as
1616 necessary to ensure safety of the residents of the facility or
1717 institution.
1818 (b) The division shall approve a plan as appropriate and
1919 provide evidence of the division's approval to the facility or
2020 institution.
2121 SECTION 2. Subchapter A, Chapter 242, Health and Safety
2222 Code, is amended by adding Section 242.018 to read as follows:
2323 Sec. 242.018. EMERGENCY MANAGEMENT PLAN. (a) An
2424 institution shall prepare and keep current an emergency management
2525 plan providing for disaster mitigation, preparedness, response,
2626 and recovery.
2727 (b) The plan must provide for:
2828 (1) evacuation of the institution; and
2929 (2) sheltering at the institution by the residents for
3030 the duration of the emergency.
3131 (c) Each institution shall submit the institution's
3232 emergency management plan to the division of emergency management
3333 in the governor's office and the city or county in which the
3434 institution is located.
3535 SECTION 3. Section 242.032, Health and Safety Code, is
3636 amended by adding Subsection (c-1) to read as follows:
3737 (c-1) Each applicant for a license or a renewal of a license
3838 shall submit evidence of approval of the institution's emergency
3939 management plan under Section 242.018 by the emergency management
4040 division in the governor's office.
4141 SECTION 4. Subchapter A, Chapter 246, Health and Safety
4242 Code, is amended by adding Section 246.008 to read as follows:
4343 Sec. 246.008. EMERGENCY MANAGEMENT PLAN. (a) Each
4444 facility shall prepare and keep current an emergency management
4545 plan providing for disaster mitigation, preparedness, response,
4646 and recovery.
4747 (b) The plan must provide for:
4848 (1) evacuation of the facility; and
4949 (2) sheltering at the facility by the residents for
5050 the duration of the emergency.
5151 (c) Each facility shall submit the facility's emergency
5252 management plan to the division of emergency management in the
5353 governor's office and the city or county in which the facility is
5454 located.
5555 SECTION 5. Section 246.022(c), Health and Safety Code, is
5656 amended to read as follows:
5757 (c) The commissioner shall grant an application for a
5858 certificate of authority if the commissioner finds that:
5959 (1) the applicant or the facility is financially
6060 sound;
6161 (2) the competence, experience, and integrity of the
6262 applicant, its board of directors, its officers, or its management
6363 make it in the public interest to issue the certificate; [and]
6464 (3) the applicant is capable of complying with this
6565 chapter; and
6666 (4) the applicant has submitted evidence of approval
6767 of the facility's emergency management plan under Section 246.008
6868 by the emergency management division in the governor's office.
6969 SECTION 6. Subchapter A, Chapter 247, Health and Safety
7070 Code, is amended by adding Section 247.007 to read as follows:
7171 Sec. 247.007. EMERGENCY MANAGEMENT PLAN. (a) Each
7272 assisted living facility licensed in this state shall prepare and
7373 keep current an emergency management plan providing for disaster
7474 mitigation, preparedness, response, and recovery.
7575 (b) The plan must provide for:
7676 (1) evacuation of the assisted living facility; and
7777 (2) sheltering at the assisted living facility by the
7878 facility residents for the duration of the emergency.
7979 (c) Each assisted living facility shall submit the
8080 facility's emergency management plan to the division of emergency
8181 management in the governor's office and the city or county in which
8282 the facility is located.
8383 SECTION 7. Section 247.022, Health and Safety Code, is
8484 amended by adding Subsection (d) to read as follows:
8585 (d) Each applicant for an assisted living facility license
8686 or renewal of a license shall submit evidence of approval of the
8787 facility's emergency management plan under Section 247.007 by the
8888 emergency management division in the governor's office.
8989 SECTION 8. A convalescent or nursing home, or related
9090 institution licensed under Chapter 242, Health and Safety Code, a
9191 continuing care facility granted a certificate of authority under
9292 Chapter 246, Health and Safety Code, or an assisted living facility
9393 licensed under Chapter 247, Health and Safety Code, shall develop
9494 an emergency management plan as required by Sections 242.018,
9595 246.008, and 247.007, Health and Safety Code, as added by this Act,
9696 as soon as practicable after the effective date of this Act.
9797 SECTION 9. The changes in law made by this Act apply to an
9898 application for a certificate of authority, a license, or a renewal
9999 of a license filed on or after the effective date of this Act. An
100100 application filed before the effective date of this Act is governed
101101 by the law in effect on the date of the filing of the application,
102102 and the former law is continued in effect for that purpose.
103103 SECTION 10. This Act takes effect September 1, 2009.
