99 relating to the provision of and billing for certain diagnostic
1010 imaging services.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subtitle A, Title 3, Occupations Code, is
1313 amended by adding Chapter 116 to read as follows:
1414 CHAPTER 116. DIRECT BILLING OF DIAGNOSTIC IMAGING SERVICES
1515 Sec. 116.001. DEFINITIONS. In this chapter:
1616 (1) "Diagnostic imaging services" means magnetic
1717 resonance imaging, computed tomography, positron emission
1818 tomography, and any hybrid technology that combines any of those or
1919 other imaging modalities.
2020 (2) "Health care provider" means any person licensed
2121 as a health care professional or authorized to practice health care
2222 under Subtitle B, C, or E.
2323 (3) "Licensing authority" means a department, board,
2424 office, or other agency of this state that licenses or otherwise
2525 regulates a health care provider who is subject to this chapter.
2626 (4) "Patient" means a person who receives a physical
2727 examination, evaluation, diagnosis, or treatment by a health care
2828 provider.
2929 (5) "Professional component of diagnostic imaging
3030 services" means the component of a medical imaging procedure that
3131 involves an interpretation to be performed by a health care
3232 provider, including the interpretation of a radiograph or the
3333 images produced by diagnostic imaging services. The term also
3434 includes valuation for the work performed by a health care
3535 provider, practice expenses, and medical liability associated with
3636 the interpretation of a diagnostic imaging service.
3737 Sec. 116.002. PROHIBITED ACTS REGARDING DIAGNOSTIC IMAGING
3838 SERVICES. Notwithstanding any other law, a health care provider
3939 violates this chapter and is subject to disciplinary action and
4040 penalties under Subtitle B, C, or E, as appropriate, if the health
4141 care provider:
4242 (1) does not directly supervise or perform the
4343 professional component of a diagnostic imaging service for a
4444 patient; and
4545 (2) fails to disclose in the bill presented to the
4646 patient or the insurer or other third party payor, or in an itemized
4747 statement to the patient:
4848 (A) the name and address of the health care
4949 provider that provided the professional component of the diagnostic
5050 imaging service; and
5151 (B) the net amount paid or to be paid for each
5252 professional component of the diagnostic imaging service provided
5353 to the patient by the health care provider.
5454 Sec. 116.003. DISCIPLINARY ACTION. A licensing authority
5555 with jurisdiction over a health care provider who may request or
5656 provide diagnostic imaging services may revoke, suspend, or refuse
5757 to renew the license or other authorization of a health care
5858 provider who violates this chapter.
5959 Sec. 116.004. RULES. The governing body of a licensing
6060 authority may adopt rules as necessary to implement this chapter.
6161 SECTION 2. Section 116.002, Occupations Code, as added by
6262 this Act, applies only to conduct that occurs on or after the
6363 effective date of this Act. Conduct that occurs before the
6464 effective date of this Act is governed by the law as it existed
6565 immediately before the effective date of this Act, and that law is
6666 continued in effect for that purpose.
6767 SECTION 3. This Act takes effect September 1, 2009.
