| 5 | 5 | | relating to the removal of illegally parked vehicles from |

| 6 | 6 | | residential parking permit areas in certain municipalities. |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 2308.354, Occupations Code, is amended |
|---|
| 9 | 9 | | by adding Subsections (c) and (d) to read as follows: |
|---|
| 10 | 10 | | (c) In addition to the authority granted under Subsection |
|---|
| 11 | 11 | | (a) and to aid in the enforcement of an ordinance regulating the |
|---|
| 12 | 12 | | parking of vehicles, a municipality with a population of 1.9 |
|---|
| 13 | 13 | | million or more may authorize a designated employee to request the |
|---|
| 14 | 14 | | removal of a vehicle parked illegally in an area designated as a |
|---|
| 15 | 15 | | tow-away zone in a residential area where on-street parking is |
|---|
| 16 | 16 | | regulated by the ordinance. |
|---|
| 17 | 17 | | (d) Subsections (a) and (c) do not apply to a vehicle owned |
|---|
| 18 | 18 | | by an electric, gas, water, or telecommunications utility while the |
|---|
| 19 | 19 | | vehicle is parked for the purpose of conducting work on a facility |
|---|
| 20 | 20 | | of the utility that is located below, above, or adjacent to the |
|---|
| 21 | 21 | | street. |

| 22 | 22 | | SECTION 2. This Act takes effect September 1, 2009. |
