55 relating to the removal of illegally parked vehicles from
66 residential parking permit areas in certain municipalities.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 2308.354, Occupations Code, is amended
99 by adding Subsections (c) and (d) to read as follows:
1010 (c) In addition to the authority granted under Subsection
1111 (a) and to aid in the enforcement of an ordinance regulating the
1212 parking of vehicles, a municipality with a population of 1.9
1313 million or more may authorize a designated employee to request the
1414 removal of a vehicle parked illegally in an area designated as a
1515 tow-away zone in a residential area where on-street parking is
1616 regulated by the ordinance.
1717 (d) Subsections (a) and (c) do not apply to a vehicle owned
1818 by an electric, gas, water, or telecommunications utility while the
1919 vehicle is parked for the purpose of conducting work on a facility
2020 of the utility that is located below, above, or adjacent to the
2121 street.
2222 SECTION 2. This Act takes effect September 1, 2009.
