55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the criteria for awarding certain medals to members of
88 the armed forces from Texas.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 431.134(a), Government Code, as amended
1111 by Chapters 740 (H.B. 2896), 741 (H.B. 2897), and 1080 (H.B. 2895),
1212 Acts of the 80th Legislature, Regular Session, 2007, is reenacted
1313 and amended to read as follows:
1414 (a) The adjutant general may adopt rules and regulations
1515 relating to the:
1616 (1) Texas Faithful Service Medal, which shall be
1717 awarded to a member of the state military forces who has completed
1818 five years of honorable service during which the person has shown
1919 fidelity to duty, efficient service, and great loyalty to the
2020 state;
2121 (2) Federal Service Medal, which shall be awarded to a
2222 resident of the state [person] who served on active duty in the
2323 United States armed forces [was inducted into federal service from
2424 the state military forces between June 15, 1940, and January 1,
2525 1946, or after June 1, 1950, if the service was] for more than 60
2626 [90] days and received an honorable discharge;
2727 (3) Texas Medal of Merit, which may be presented to a
2828 member of the military forces of this state, another state, or the
2929 United States who performs outstanding service or attains
3030 extraordinary achievement in behalf of the state or United States;
3131 (4) Texas Outstanding Service Medal, which may be
3232 presented to a member of the military forces of this state, another
3333 state, or the United States who has performed service in a superior
3434 and clearly outstanding manner;
3535 (5) Texas State Guard Service Medal, which shall be
3636 awarded to a person who completes three consecutive years of
3737 honorable service in the Texas State Guard during which the person
3838 has shown fidelity to duty, efficient service, and great loyalty to
3939 the state;
4040 (6) Texas Desert Shield/Desert Storm Campaign Medal,
4141 which shall be awarded to a person who was inducted into federal
4242 service from the Texas National Guard after August 1, 1990, in
4343 support of Operation Desert Shield or Operation Desert Storm,
4444 without regard to the place that the person was deployed while
4545 serving on active federal military duty;
4646 (7) Texas Humanitarian Service Medal, which shall be
4747 awarded to a person who:
4848 (A) does not meet the criteria for an award of the
4949 federal Humanitarian Service Medal;
5050 (B) is a member of the state military forces; and
5151 (C) while serving on state active duty or active
5252 duty under state authority in accordance with Title 32 of the United
5353 States Code, participates satisfactorily in defense support to a
5454 mission under civilian authority to protect life or property during
5555 or soon after a natural disaster or civil unrest in the state;
5656 (8) Texas Cavalry Medal, which shall be awarded to a
5757 person who:
5858 (A) served on or after September 11, 2001, in the
5959 124th Cavalry, Texas Army National Guard; and
6060 (B) served in a hostile fire zone as designated
6161 by the United States secretary of defense;
6262 (9) Texas Combat Service Ribbon, which shall be
6363 awarded to a member of the Texas National Guard who served, after
6464 September 11, 2001, in a hostile fire zone as designated by the
6565 United States secretary of defense;
6666 (10) Texas Purple Heart Medal, which shall be awarded
6767 to a person who[, after September 11, 2001]:
6868 (A) was inducted into federal service from the
6969 Texas National Guard; and
7070 (B) meets the criteria for an award of the
7171 federal Purple Heart Medal; [and]
7272 (11) Texas Superior Service Medal, which shall be
7373 awarded to:
7474 (A) a member of the state military forces who
7575 has:
7676 (i) completed 30 or more years of honorable
7777 state service or a combination of state and federal service; and
7878 (ii) continually demonstrated superior
7979 performance and service while assigned to key leadership positions
8080 demanding responsibility; or
8181 (B) a civilian who has contributed significant
8282 service to the state military forces; and
8383 (12) [(11)] Texas Homeland Defense Service Medal,
8484 which shall be awarded to a member of the state military forces who
8585 served:
8686 (A) on or after September 11, 2001;
8787 (B) on state active duty or active duty under
8888 state authority in accordance with Title 32 of the United States
8989 Code; and
9090 (C) satisfactorily in defense support to a
9191 mission in the state under civilian authority.
9292 SECTION 2. This Act takes effect September 1, 2009.
